CERTIFICATION OF RESOLUTION <br /> TO: Boulder Board of County Commissioners <br /> FROM: Boulder County Planning Commission <br /> This is to certify that at a meeting of the Planning Commission of the <br /> County of Boulder, State of Colorado duly called and held on Wednesday, <br /> November 18, 1981, the following resolution was duly adopted: <br /> "Be it Resolved by the Planning Commission of the County of <br /> Boulder, State of Colorado, that it recommend to the Board <br /> of County Commissioners of said County CONDITIONAL APPROVAL, <br /> subject to the following: <br /> 1) Although basic conceptual layouts of the Alternate Excavation <br /> Plan Map and Reclamation Plan Map for the entire property are <br /> generally acceptable, Special Use approval is strictly limited <br /> to the first two (2) stages of mining as identified on the <br /> Alternate Excavation Plan Map or a maximum period of seven (7) <br /> years of operation. Formal review and Special Use approval <br /> will be required prior to commencing any mining activities <br /> on stages 3 through 6. The map submitted by the applicants <br /> and entitled the "Alternative Excavation Plan Map" which <br /> shows the stage 1 operations area located near the eastern <br /> boundary of the property is the approved mining plan map with <br /> the exception of revisions to haul roads as recommended <br /> in conditions 6, 7 and 9. <br /> 2) That the maximum allowable standard for noise from activities <br /> on the mining site is L = 53dBA, which is to be measured and <br /> calculated according to4he accepted standards of the U.S. <br /> Environmental Protection Agency (EPA). A monitoring program <br /> is to be conducted by a professional acoustics consultant <br /> at the applicant's expense. The monitoring site is to be <br /> located immediately behind the property known as 1230 Chambers <br /> Drive. The monitoring procedure is to be as proposed on page 4 <br /> of the December 2, 1981 letter from Charles M. Salter Associates. <br /> Additional monitoring as spot checks and also in response to <br /> any complaints will be done by County staff with the assistance <br /> of qualified City of Boulder or Boulder County personnel . <br /> Initial scraping operations for the removal of topsoil or <br /> overburden in a new mining area will be exempt from the noise <br /> level standard (but not any federal , state or local standard <br /> which would otherwise be applicable) , subject to the condition <br /> that the applicants conduct the operations as efficiently as <br /> possible to minimize the lengths of time that these operations <br /> are being conducted. <br />
