Findings of the <br />Colorado Mined Land Reclamation Division <br />for the <br />Cyprus Empire Corporation's <br />Craig Town Loadout <br />Performance Bond Release Application <br />I. Procedures for Seeking Release of Performance Bond (Rule 3.02.2) <br />The Division finds that, based on the review process history, the <br />requirements for seeking release of performance bonds and liability as <br />set forth in Rule 3.03.2 have been met. Copies of written notices as <br />required by Rule 3.02(1)(a) have been submitted to the Division. Proof <br />of publication in accordance with Rule 3.02.291)(b) have also been <br />submitted. A site inspection was held in accordance with Rule 3.03.2(2). <br />II. Criteria and Schedule for Release of Performance Bonds <br />The Mined Land Reclamation Division currently holds performance bonds <br />for Cyprus Empire Corporation for 53,179,725.00. Of this amount <br />515,392.00 applies to the Craig Town Loadout Facility. <br />The current condition of the Loadout follows the approved post-mining land use <br />and the Loadout has been reclaimed as approved in the permit application. <br />The Loadout facility has a sufficient ground cover of living plants to control <br />erosion as required in Rule 4.15.10(2), revegetation success criteria for <br />industrial post-mining land use. <br />-3- <br />
