Summary of the Review Process <br />The Cyprus Empire Corporation has applied for Bond Release for the Craig Town <br />Loadout Facility (Permit No. C-81-044) under the Colorado Surface Coal Mining <br />and Reclamation Act. The Division does hold a reclamation performance bond <br />for the Loadout facility. The reclamation liability is in the amount of <br />515,392.00. Release of the bond will effectively release Cyprus Empire <br />Corporation from any further maintenance, reclamation, or enforcement <br />liability associated with the Loadout. <br />The approximately 20 acre site is located on both sides and adjacent to <br />First Street, east of Ranney Street and west of the railroad crossing; in the <br />N 1/2 of the SE 1/4 and the S 1/2 of the NE 1/4, Section 1, Township 6 North, <br />Range 91 West, of the 6th P.M. <br />The approved reclamation plan for the Loadout was to remove all structures and <br />waste materials, grade the area, reapply topsoil, seed and mulch as described <br />in Exhibit 23 of the approved Permit Application. The post-mining land use <br />for the area is industrial. <br />On October 6, 1989, the Division received a application from Cyprus Empire <br />Corporation requesting bond release for the Craig Town Loadout. The Division <br />reviewed the request pursuant to Rule 3.03 and on October 16, 1989 determined <br />that the application was incomplete. On November 3, 1989 the Cyprus Empire <br />Corporation responded to the Division with Uie required information. The <br />application was deemed complete and an inspection was scheduled for <br />December 1, 1989. On December 1, 1989 a bond release inspection was conducted <br />at the Loadout facility. Present during the inspection were Tony Waldron and <br />Jim Stevens of CMLRD, Terrell Johnson of Cyprus Empire Corporation and <br />Mitchell Rollings of the Office of Surface Mining. The owner of the property, <br />Denver and Rio Grande Western Railroad Company, was contacted by phone on <br />November 27, 1989 and informed of the forthcoming inspection. Their <br />representative chose not to be present during the inspection tour. The entire <br />Loadout area within the permit boundary was inspected. The area was level, <br />smooth and generally well vegetated. The vegetation appeared to be comprised <br />primarily of smooth brume grass. The area exhibited no signs of erosion and <br />met the revegetation success criteria for industrial post-mining land use <br />(Rule 4.15.10(2)). <br />-2- <br />
