The demolition costs associated with areas successfully backfilled and graded are eligible for Phase I bond release. However, Picketwire Processing also requested a partial Phase I bond release where structures were removed but were located in areas where backfilling and grading have not been completed. The demolition cost for these structures are not eligible for bond release until such time that all required Phase I activities, including backfilling, grading, and drainage control, have been completed. The Division cannot approve a partial Phase bond release for structure demolition where backfilling and grading has not been completed in accordance with the approved reclamation plan. Direct and indirect costs for these activities results in a dollar amount of bond to release of $286,352.00 (line item #3 in Table B). The detailed cost estimate for work performed is also included in Appendix A, Part 3 of Exhibit 28 of the approved permit.
