-2- <br />Proposed Decision <br />Colorado Coal Mining Company <br />Colorado Coal Mine No. 1 <br />The Colorado Mined Land Reclamation Division proposes to partially <br />approve, with stipulations, an application for a permit to conduct coal <br />mining operations submitted by Colorado Coal Mining Company (GCMG) for <br />the Colorado Coal Mine No. 1. The partial approval in this case refers <br />to that part of the application referred to as the "dry mine plan" by <br />CCMC, as defined later in this document. <br />The approval decision is based on a finding that the proposed operation <br />will comply with all requirements of the Colorado Surface Coal Mining <br />Reclamation Act, C.R.S. 1973, as amended, 34-33-101 et seg., and the <br />Regulations promulgated pursuant to the Act. <br />The permit application and the stipulations will become a binding part of <br />the permit upon approval. The stipulations for Colorado Coal Mine No. 1 <br />are as follows: <br />List of Stipulations <br />Stipulation No. 1 <br />THE PERMITTEE SHALL ESTABLISH A TOTAL OF FIVE SURFACE WATER <br />MONITORING STATIUNS AT THE MINING SITE. THESE SHOULD BE LOCATED <br />AT THE FOLLOWING POINTS: UPSTREAM OF THE MINING OPERATION ON <br />THE 1~1HITLAND HNU GURDON ARROYOS AfdD THE UNNAMED TRIBUTARY OF THE <br />MAITLAND ARROYO AND DOWNSTREAM OF THE MINING OPERATION ON THE <br />MHITLAND ANU GORDON ARROYOS. <br />THESE FIVE STATIUNS SHALL EACH BE MONITORED IN THE FOLLOWING <br />MANNER: 1) A DAILY RECORD OF THE OCCUKRENCE OF FLOWS IN ALL <br />STRENM DRAINAGES (e. g. WAS THERE ANY FLOW?); 2) N DAILY UEPTH OF <br />WATER READING; 3) A WEEKLY MEASUREINENT OF PEAK FLOWS; 4) MONTHLY <br />FIELD MEASUREI4ENTS OF pH, ELECTKO-CONDUCTIVITY, AND TEMPERATURE <br />DURING A PERIOD OF SNOWMELT AND/OR DURING THE FIRST <br />PRECIPITATION EVENT OCCURRING IN THE MONTH; AND 5) A MINIMUM OF <br />THREE WATER QUALITY SAMPLES FOR EACH OF THE STATIONS SHALL BE <br />COLLECTED ANNUALLY. ONE SHALL BE COLLECTED DURING SNOWMELT, UNE <br />DURING A PRECIPITATION EVENT IN MIDSUMMER, AND ONE UURING A <br />PRECIPITATION EVENT AT THE END OF SUMMER. FIELD PARAMETERS OF <br />pH, ELECTRO-CUNUUCTIVITY, TEMPERATURE, AND FLOW SHALL BE TAKEN <br />PRIOR TO SAMPLING AS DESCRIBED ABOVE. THEN THE SAMPLES MUST BE <br />ANALYZED IN A TIMELY MANNER FOR THE FOLLOWING PARAMETERS (TOTAL <br />ION CONCENTRATIONS IN mg/1): <br />
