OF NATURAL RESOU~CE~ <br />RE: Energy Fuels Permit 79-177, Special Stipulation No. 11 <br />Gentlemen: <br />This letter constitutes Energy Fuels' response to the Office of <br />Surface Mining with respect to Special Stipulation No. 11 to Energy Fuels <br />Corporation Permit 79-177 which states: <br />"11. By September 1, 1980, the applicant shall submit, to the regu- <br />latory authority for approval reclamation plans describing and locat- <br />ing the stand size, stocking, and site and species relations of the <br />trees and shrubs that will be either transplanted, planted, or seeded. <br />This plan shall include a detailed description and location map of <br />the proposed vegetation communities that will be established." <br />The rational used by O.S.M. in developing this stipulation is pre- <br />sented on pages 17 - 21 of O.S.Pf.'s technical assessment per Section <br />816.117 of the Eckman Park Mining and Reclamation Plan. <br />It is Energy Fuels' experience that the approach to reestablishing <br />woody plants stipulated by 30 CFR 816.117 (c) was addressed adequately in <br />the proposed seeding, seeding transplant, and mature plant transplanting <br />program presented by Energy Fuels under Section 780.18 of the Eckman Park <br />Mining and Reclamation Plan. <br />The preamble to Section 816.117 states that "...OSM believes that 450 <br />trees per acre will provide sufficient flexibility to satisfy most recom- <br />mended reforestation practices..." As can be observed on the two enclosed <br />~ ------ <br />
