OF NATURAL RESOU~CE~ RE: Energy Fuels Permit 79-177, Special Stipulation No. 11 Gentlemen: This letter constitutes Energy Fuels' response to the Office of Surface Mining with respect to Special Stipulation No. 11 to Energy Fuels Corporation Permit 79-177 which states: "11. By September 1, 1980, the applicant shall submit, to the regu- latory authority for approval reclamation plans describing and locat- ing the stand size, stocking, and site and species relations of the trees and shrubs that will be either transplanted, planted, or seeded. This plan shall include a detailed description and location map of the proposed vegetation communities that will be established." The rational used by O.S.M. in developing this stipulation is pre- sented on pages 17 - 21 of O.S.Pf.'s technical assessment per Section 816.117 of the Eckman Park Mining and Reclamation Plan. It is Energy Fuels' experience that the approach to reestablishing woody plants stipulated by 30 CFR 816.117 (c) was addressed adequately in the proposed seeding, seeding transplant, and mature plant transplanting program presented by Energy Fuels under Section 780.18 of the Eckman Park Mining and Reclamation Plan. The preamble to Section 816.117 states that "...OSM believes that 450 trees per acre will provide sufficient flexibility to satisfy most recom- mended reforestation practices..."
