<br />Reclamation Board, Department of Natural Resources, State of Colorado.
<br />• W I T '1 E S S E T H
<br />WHEREAS, Flatiron Paving Company ~ desires to conduct a(n) surface coalmining
<br />operat_on, known as Bourg Coal Strip Mine for the purpose of-extracting coal
<br />mined open and
<br />tv-HERr~S, on July 3 1980 , Flatiron Paving Company "FILED" an
<br />application,a reclamation plan and map, and the required fee, as required by law; and
<br />'.,1iERE~S, on January 24 1980 the `fined Land Reclamation Board approved
<br />Flatiron Paving Company application and set bond; and
<br />!.'HE?.EAS, on July 15 1980 the `fined Land Reclamation Board accepted
<br />surety submitted by Flatiron Paving Company and such date shall be considered the
<br />date of issuance of the permit and the anniversary date for all other purposes; and
<br />f.'HEREAS, the `fined Land Reclamation Eoard has made a finding, for the purposes
<br />of issuing this permit, that:
<br />1) the application complies with the requirements of the Colorado
<br />`lined Land Reclamation Act and all applicable local, state and
<br />Federal laws; and,
<br />?) the operation will not adversely affect the stability of any
<br />significant, valuable, and permanent man-made structures located
<br />within two hundred feet of the affected land, e::cept where there
<br />is an agreement bet•.+een the operator and the persons having an
<br />interest in the structure that damage to the structure is to be
<br />compensated for by the operator; and,
<br />3) [he proposed mining operations and reclamation can be carried out
<br />in conformance with the requirements of C.R.S. 1973, 34-32-116, as
<br />.amended (1976 Sess. Laws N.. E. 106 0 ; and
<br />;,Y.EREAS, for the purposes of issuing this permit, the operator has made a
<br />satisfactory showing to the Board chat ite will employ during and after his
<br />surface coal mining operations procedures reasonably designed to minimize
<br />as much as practicable the disruption from the surface coal mining operations
<br />and will provide for the rehabilitation of the affected land through the rehabilitation
<br />of p'_anc cover, soil stability, water resources, and other measures appropriate to the
<br />subsequent beneficial use of such mined and reclaimed lands; and that in the event
<br />of the fa_lur_ of his proposed reclamation plan, he tri l'_ ta>`e whatever measures •~hich
<br />may be necessary in order to assure the success of reclamation of the lands affected
<br />by his surface coal mining operations; and,
<br />:dHERE_a5, for the purposes of issuing this permit, a copy of the application
<br />a?Droved by the Mined Land Reclamation Board of the State of Colorado is attached
<br />to this permit and thereby becomes a part of the terms hereof.
<br />VOW, THEREFORE, pursuant to the authority sac forth in the Colorado Mined
<br />Land Reclamation Act, Article 32 of Tit'_a 34, C.R.S. 1973, as amended, (1976
<br />Sass. Lass ki.3. 1060 the `lined Land Reclamation Board of the Scace of Colorado
<br />hereby issues a life of the nine permit to Flatiron Paving Company to enga_e
<br />in surface coal minine for tie purpose of extractine coal
<br />mined open on t:te following panel of ground, to wit:
<br />170.3 acres in Jackson County, Colorado, further described as follows:
<br />Mine: S~, SE>;, Sec. 7, N~, NE4, Sec. 18, T.9N, R. 78W of the 6th P.M.
<br />Access Road: A 60 foot right-of-way in the SEA of the NW}, the SW~
<br />of [he NEz, the IV'd; of the SEz and the SEw of The SE'.,
<br />all in Set" :^ 12, T. 9N, R. 79W; and the S~:c of the
<br />SW~ and the SEA of the SF:=,'of Section 7, 7. 9N; R. 78W,
<br />all west of the 6th P.M. in Jackson County, Colorado.
