<br />I recommend approval of the Deserado mine mining plan, as modified, pursuant
<br />to the Mineral Leasing Act of 1920, as amended. i~ty recommendation to approve
<br />the Deserado mine mining plan, as modified, is based on: (1) Western
<br />Fuels-Utah, Inc.'s complete permit revision application, as updated through
<br />November 23, 1987, (2) review of the permit revision application by the State
<br />of Colorado as required by the Colorado State program and cooperative
<br />agreement, (3) the Federal lands review pursuant to section 522(b) of the
<br />Surface Mining Control and Reclamation Act of 1977 (SMCRA), (4) comments and
<br />recommendations or concurrence of other Federal agencies, including the
<br />findings and recommendations of the Bureau of Land Management with respect to
<br />the resource recovery and protection plan and other requirements of the
<br />Federal leases and the Mineral Leasing Act of 1920, as amended, (5) compliance
<br />with the National Environmental Policy Act of 1969, and (6) documentation
<br />assuring compliance with applicable requirements of other Federal laws,
<br />Executive Orders, and regulations.
<br />The Secretary may approve a mining plan, as modified, for Federal lands under
<br />30 U.S.C. Z07(c) and 1273(c). I find that the proposed operations will be in
<br />compliance with all applicable laws and regulations, and I recommend the
<br />Deserado mine mining plan, as modified, updated through November 23, 1987, be
<br />approved.
<br />The Deserado mine mining plans approved in July 1981 and D1ay 1986, along with
<br />this mining plan modification, are reflected in the proposed mining plan
<br />approval document included with this memorandum.
<br />Approval:
<br />I approve the Deserado mine mining plan, as modified and the attached mining
<br />plan approval doctnoent number CO-0038, dated February 1988. This mining plan,
<br />as modified, supersedes the Deserado mine mining plans approved in July 1981
<br />and hfay 1986.
