DEPARTMENT OF THE ISTERIOR OFFICE OF SURFACE MINING RECLAMATION AND ENFORCEMENT NOTICE OF A DECISION AND AVAILABILITY GF BOTH A TECHNICAL ANALYSIS AND AN EA'~ IRONFtENTAL ASSESSMENT FOR, EPfPIRE ENERGY CORPORATION PERMANENT PROGRAM PERMIT EAGLE Z:O. 5 AND N0. 9 MINES ~(OFFAT COUNTY, COLORADO The United States Department of the Interior, Office of Surface Mining Reclamation and Enforcement (OSM), has approved, with conditions, a 5-year permit for Empire Energy Corporation to mine coal at its Eagle No. 5 mine and to conduct environmental monitoring and to maintain the surface facilities at the Eagle No. 9 mine. The OSM has no[ approved the mining of coal at the Eagle No. 9 mine. The Eagle No. 5 and No. 9 underground coal mining operations are located in Moffat County, Colorado, approximately 7 miles southwest of Craig, Colorado. The mines have been in operation since 1971. The proposed permit area will cover approximately 5,397 acres, approximately 220 acres of which have been disturbed to date for surface facilities for the underground operation. Maximum mine production is at a projected rate of 1.2 million tons of coal per year over 5 years. Any person with an interest which is or may be adversely affected by this Federal permit approval action may request an adjudicatory hearing on the final decision within 30 days after publication of this notice, in accordance with Section 514(c) of the Surface Mining Control and Reclamation Act (SMCRA). Any hearing will be governed by provisions of 5 U.S.C. Section SSL. Sections 1501.4(c) and 1506.6, notice is hereby given that Colorado Mined Land Reclamation Division has completed a technical analysis (TA) for [he mining and reclamation plan (MRP) for the Eagle No. 5 and No. 9 mines, Moffat County, Colorado. OSM has supplemented this TA with its own environmental assessment (EA). OSM's recommendation to approve Empire Energy Corporation mining plan and the permit application with conditions is in accordance with Sections 510 and 523 of SMCRA. OSM's analysis is that no significant environmental inpacts would result from such approval.
