DEPARTMENT OF THE ISTERIOR <br />OFFICE OF SURFACE MINING <br />RECLAMATION AND ENFORCEMENT <br />NOTICE OF A DECISION AND AVAILABILITY <br />GF BOTH A TECHNICAL ANALYSIS AND AN <br />EA'~ IRONFtENTAL ASSESSMENT FOR, <br />EPfPIRE ENERGY CORPORATION <br />PERMANENT PROGRAM PERMIT <br />EAGLE Z:O. 5 AND N0. 9 MINES <br />~(OFFAT COUNTY, COLORADO <br />The United States Department of the Interior, Office of Surface Mining <br />Reclamation and Enforcement (OSM), has approved, with conditions, a 5-year <br />permit for Empire Energy Corporation to mine coal at its Eagle No. 5 mine and <br />to conduct environmental monitoring and to maintain the surface facilities at <br />the Eagle No. 9 mine. The OSM has no[ approved the mining of coal at the <br />Eagle No. 9 mine. <br />The Eagle No. 5 and No. 9 underground coal mining operations are located in <br />Moffat County, Colorado, approximately 7 miles southwest of Craig, Colorado. <br />The mines have been in operation since 1971. The proposed permit area will <br />cover approximately 5,397 acres, approximately 220 acres of which have been <br />disturbed to date for surface facilities for the underground operation. <br />Maximum mine production is at a projected rate of 1.2 million tons of coal <br />per year over 5 years. <br />Any person with an interest which is or may be adversely affected by this <br />Federal permit approval action may request an adjudicatory hearing on the <br />final decision within 30 days after publication of this notice, in accordance <br />with Section 514(c) of the Surface Mining Control and Reclamation Act <br />(SMCRA). Any hearing will be governed by provisions of 5 U.S.C. Section <br />SSL. Sections 1501.4(c) and 1506.6, notice is hereby given <br />that Colorado Mined Land Reclamation Division has completed a technical <br />analysis (TA) for [he mining and reclamation plan (MRP) for the Eagle No. 5 <br />and No. 9 mines, Moffat County, Colorado. OSM has supplemented this TA with <br />its own environmental assessment (EA). OSM's recommendation to approve <br />Empire Energy Corporation mining plan and the permit application with <br />conditions is in accordance with Sections 510 and 523 of SMCRA. OSM's <br />analysis is that no significant environmental inpacts would result from such <br />approval.
