for Transfer of Permit Rights for Nucla Mine
(Permit C-81-008)

Pursuant to Rule 2.08.6(4) of the Regulations of the Colorado Mined Land
Reclamation Board for Coal Mining (Rules) promulgated pursuant to the Colorado
Surface Coal Mining Reclamation Act (Act) 34-33-101 et. seg. C.R.S. 1973 as
amended, the Division makes the following three written findings prior to the
approval of the transfer of rights under the permit for the Nucla Mine
(Permit C-81-008):
1. The Division finds the person seeking approval, Western Fuels, Colorado,
eligible to receive a permit in accordance with Rule 2.07.b(1)(b), (c>,
and (2);
2. The Division finds the applicant, Western Fuels, Colorado, has submitted
a performance bond at least equivalent to the bond of the original
permittee; and
3. The Division finds the applicant, Western Fuels, Colorado, will Conduct
the operations involved in full compliance with the terms and conditions
of the original permit and in accordance with the requirements of the Act
and these rules.
