<br />Colorado Mined Land Reclamation Division <br />Michael B. Long, Director <br />Findings of the Colorado Mined Land Reclamation Division <br />for Transfer of Permit Rights for Nucla Mine <br />(Permit C-81-008) <br />May 1992 <br />Pursuant to Rule 2.08.6(4) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining (Rules) promulgated pursuant to the Colorado <br />Surface Coal Mining Reclamation Act (Act) 34-33-101 et. seg. C.R.S. 1973 as <br />amended, the Division makes the following three written findings prior to the <br />approval of the transfer of rights under the permit for the Nucla Mine <br />(Permit C-81-008): <br />1. The Division finds the person seeking approval, Western Fuels, Colorado, <br />eligible to receive a permit in accordance with Rule 2.07.b(1)(b), (c>, <br />and (2); <br />2. The Division finds the applicant, Western Fuels, Colorado, has submitted <br />a performance bond at least equivalent to the bond of the original <br />permittee; and <br />3. The Division finds the applicant, Western Fuels, Colorado, will Conduct <br />the operations involved in full compliance with the terms and conditions <br />of the original permit and in accordance with the requirements of the Act <br />and these rules. <br />
