Final armoring of the ditch is proceeding with seeding and <br />mulching to be accomplished in the spring of 1995. <br />As per permit requirements and Stipulation No. 5, the operator will inspect the <br />waste pile quarterly and test the soil for additive requirements prior to seeding. <br />Records show that the last P.E. inspection of the pile occurred on August 15, 1994. <br />Pile certification was issued on May 24, 1984. The last compaction test was run on <br />July 13, 1993, six weeks prior to the cessation of operations. <br />An additional refuse pile, to be located at the sales site, was permitted and approved <br />with the submittal of Technical Revision No. 3. Due to the cessation of operations, <br />the pile was never constructed. <br />IX. Backfilling and Grading <br />In accordance with the final reclamation plan set forth in Technical Revision No. 7, <br />after removal of all mine structures and facilities not approved as permanent, and <br />sealing of the portal entries, mine-disturbed areas will be backfilled and graded. <br />The goal of TR-07 is to establish apost-mining contour and configuration which <br />complies with regulatory requirements and assures long-term stability while blending <br />with the surrounding terrain, to the extent possible. <br />Twin Pines Investment Limited has already removed most mineyard equipment and <br />mining-related machinery from both the portal and sales site. The shop/warehouse <br />infrastructure has been removed, leaving the concrete pad to be rubblized and placed <br />at the entrance of the backfilled portals. The refuse pile has been backfilled and <br />graded as described above in Section VIII. Areas that remain to be backfilled and <br />graded are the upper bench and mine bench, Lewis Gulch Fill exposed embank- <br />ments, and the ramp access to the tipple and the adjacent area at the sales site. <br />Normal backfilling and grading practices will continue to be applied to the disturbed <br />areas of the portal and sales sites. Both areas are to be scarified and left in a <br />roughened condition in order to improve the bonding of the regraded surface with <br />the topsoil and promote vegetative growth and reestablishment. <br />All requirements of Rule 4.14.1(2)(e), (f) and (g) have been complied with and <br />satisfied by the submittal and subsequent correspondence of TR-07. The operator <br />has demonstrated with historic and photographic evidence that all highwalls on both <br />the mine and sales site were in existence prior to the present operation and prior to <br />August 3, 1977. All reasonably available spoil in the permit area will be used to <br />backfill the highwall to the extent possible and reclaim the site to ensure stability, <br />while complying with the post-mining land use. Adequate drainage will be provided <br />and all exposed coal seams will be adequately covered. There is no necessity to <br />cover potentially acidic or toxic-forming materials since it. has been determined Twin <br />Pines has not produced any of these materials. <br />X. Revegetation <br />The Division proposes to approve the use of introduced species in the reclamation <br />seed mix.
