And because Weld County failed to <br />consult and properly adhere to their standards has meant violation <br />of law by Weld County and resulted in a negligent, #'aulty, dangerous <br />operation at the Hoekstra Pit. Operating with out benefit of manda- <br />tory standards and even Permits in the past have eliminated the pro- <br />tection now and in the future of both the effected land and the neigh- <br />boring lands. Failure to consult and comply with expertise and the <br />mandatory standards thereot', demonstrate how Weld County has been able <br />to operate at the loekstra Pit with out, for example, rip-rap or energy <br />drops either on their Location or on our property, .adjacent and down- <br />stream. The result i~ detrimental. Our property now and for years <br />past experiences obvious damage. <br />Almost three years have passed and Weld County has not: <br />I. completely fulfilled the need of properly constructing the berm <br />between the St. Vrain and the Hoekstra Pit. Width of the berm is <br />certainly important, but of Greater importance, maybe, is the fact <br />that the berm is not. at maximum original, natural height as before <br />gravel operations. Crot~nci distance between .Pit and Creek is around <br />30 feet less than reriuirements. <br />II. Weld County did not Plash Gravel from their pit toward the bank <br />as requested by the Army Corp of Engineers, but in violation gouged <br />and mined the Creeh the length of the Weld County property at a depth <br />of 15 to 20 feet. We]d County used the gravel to build the berm they <br />destroyed, but aluo carted about half off for their own use. Gougein~ <br />the Creek has caused further erosion and damage reported in your paper. <br />Naturally, this disturbance in the Creek bed has again redirected and <br />changed the velocity of the flow thus enhancing the damage to our prop- <br />erty since we are adjacent and down-stream. Our banks, both North and <br />South, may soon be lost because of the inconsistent forces directed at <br />them by Weld County gravel operation. Our banks have never been pro- <br />tected by Weld County. Even evidence from one of 6•Jeld County's own <br />operators confirm that the work was not planned, etc., but rather to <br />quote him, it was "Eye-balled". <br />III. Weld County has not fulfilled the proper distance from the Hoekstra <br />Pit and our fish pond. The distance required is 200 feet. Our pond <br />Y.:,w ~ <br />
