Also, <br />thanks for a copy of the inspection report. <br />Please bear with me while 7 state some, but riot all pertinent <br />information in ttia: 'inc:d Land and Reclamation rules and regulations <br />in reference Co our rrluity, darna~;es to our property: that an appli- <br />cant must submit an apl~l.ication which addresses the hydrologic im- <br />pacts of mining to ensure that all measures are planned to prevent <br />or at least minimize floodinP and damaees to adjacent property; that <br />outside of the effected area land shall be protected from slides and <br />damage occurring durinF~ and after the minin,r operation and reclamation. <br />Strict lia.bi]ity has been enforced by courts where the up-stream <br />land owner has a.lt.ere~.l natural drainage or flow conditions and caused <br />damage to a down-stream land owner. <br />There now is evidence, col id and beyond doubt, that Weld County <br />has mined the 3t. Vrain Creek on many occassions which has effected <br />the velocity and direction of water flow and thus facilitated the <br />potential for bank erosion. This is evident on our property. Evi- <br />dence can show that 'nle.ld County worked the St. Vrain Creek with out <br />consulting proper authorities, such as the Corp of Engineers, the <br />Mined Land Reclamation Iioar~d, the Environmental Protection Agency, <br />and even Weld County's own statutes were ignored.
