To avoid confusion, the numbering sequence of this <br />letter conforms to the numbering_ sequence used in MLRD's initial Adeouacy <br />Review letter dated January 30, 1990. <br />The following concerns require additional clarification in order to adeouatel_v <br />comply with the Colorado Surface Coal tdining Reclamation Act, 34-33-101, <br />et sea. C.R.S. 1973 as amended and its promulgated regulations. Responses to <br />Questions 2, 4, 6 7, 8, 1D, 13, 14, and 16 have been found to be adequate. <br />P&t4 has shown eleven restored drainages on Exhibit 3.4-1. The mid slope <br />haul road shows culverts that will concentrate all the upslone runoff and <br />discharge the runoff below the slope on reclaimed areas. No narrative or <br />design discusses energy dissipation or the spreading of these flows to <br />minimize downslope erosive action. P8M should Submit a plan to minimize <br />and control erosion below the culvert outfalls. <br />Currently it does not appear that all disturbed drainage from the excess <br />spoil disposal area at the south end of the tdoffat area would be <br />intercepted by the collection ditch. Please extend the ditch or provide <br />other means to ensure collection of all disturbed drainage. <br />3. Topsoil details have been placed on Exhibit 4.3-1. There remain problems <br />with the delineations on Exhibit 4.3-1 "Topsoil Removal Years Related to <br />Mining Years." <br />~\/ A. Should the "End of Topsoil Replacement - Year 19 (EOTR-YR 19)" line <br />uF-- extend east to the topspil removal boundary line? If so, please <br />change it. <br />B. The area to the north of the "EOTR-YR 19" line needs to be labeled <br />O~ to indicate when it will be topsoiled. <br />
