Mountain Coal Company, West Elk Mine would repair the road' for'' ~T ,~ <br />their access. The road is impassable. To use the alternate ;'~ ~~", <br />route up Minnesota Creek takes at least 2 to 2 1/2 hours more of <br />our time of our valuable time to accomplish this trip. This is <br />not acceptable with us at all, and the road. up Lone Pine must be <br />fixed and repaired so that it is useable for vehicular travel, <br />not by foot, or horse back. We could not. even get our guests <br />into this cabin through the entire summer season, because we <br />could not use the road to get the supplies to this facility. <br />4. We are told by Mountain Coal Company, West Elk Mine, <br />that the spring at Lone Pine is causing the problem, this is the <br />Spring that Mountain Coal Company, West Elk Mine, denied knowing <br />about in June of 1993. This spring has the pipe line from the <br />spring to the cabins broken as a result of the mining under <br />ground. This was first brought to your attention in a letter <br />written June 4, 1993. This Spring problem started before June 4, <br />1943 and is getting worse as months go by. I understand that the <br />mine is now monitoring this sight as well as they now have the <br />cabins on their inventory of structures. We still have the <br />photo's of the pipe line damage. Now this spring runs to much <br />water for the mine to work with. Their Stories don't have any <br />consistency, with the denial knowledge of the spring existing and <br />now having the existing spring having more water than Mountain <br />Coal Company, West Elk Mi a ever expected. This Spring was there <br />before and is still there. Mountain Coal Company, West Elk Mine <br />knew about this spring and old cabins from the beginning. <br />5. We need to address the repairs to our cabin up the Lone <br />Pine area, a letter addressed to Mountain coal company, West Elk <br />Mine was sent November 29, 1994 address these problems before <br />hand. Do to the request and mining of Mountain Coal Company, <br />West Elk Mine, this cabin being vacated from November 27, 1994 to <br />December 15, 1994. We have been told that there was damage to <br />the cabin, which we also have observed. I was told that the <br />subsidence was complete on August 1, 1995. We have not used the <br />cabin because Mountain Coal Company, West Elk Mine was uncertain <br />as to when the subsidence would stop. We have lost all revenues <br />for the Summer use of this cabin. <br />6. We need to address when the repairs will start and be <br />completed or will we be loosing more revenue from the actions of <br />Mountain Coal Company, West Elk Mine? I have asked that the <br />repair be done by September 6, 1995, but was told that this is <br />not possible. <br />7. We addressed a snowmobile trail around the fan area with <br />Mountain Coal Company, West Elk Mine on November 29, 1994, this <br />trail needed to be at lease six foot wide path with natural snow, <br />starting December 20, 1994 through March 1, 1995. This trail was <br />there before the fan was proposed, the trail in front of the fan <br />is not a road for our guests to use, nor our guides, for this <br />road has no snow and is not groomed. This matter was not <br />addressed. Snowmobiling does generate a good deal of revenue for <br /> <br />
