Mr. Jim Tatum
- 2 -
December 29, 1993
4. We will request from the permittee the information you discuss regarding
subsidence monitoring that may have been conducted on your property. As
the room-and-pillar operations associated with the First North Main
stopped 350 feet from your residence and the rate of mining at that time
was less than 350 feet per month, the subsidence monitoring required per
Permit Stipulation No. 28 had yet to commence. We will be glad to submit
to you a copy of any survey data we receive.
5. Regarding your inquiry into a bond being posted for the well and the
surface damage at the mine airshaft, the Division approved Technical
Revision No. 15 on November 27, 1990, with an associated reclamation bond
increase of $17,421.27. This occurred apparently prior to your
discussions with KN Energy regarding your well in April of 1991.
Rule 2.03.9(1) discusses public liability insurance that permittees are
required to maintain for the life of their operation. A certificate
certifying that a policy for the insurance is in force shall, according
to the rule, "Provide for personal injury and property damage protection
in an amount adequate to compensate any persons injured or property
damaged as a result of surface coal mining and reclamation operations,
including use of explosives, and entitled to compensation under the
applicable provisions of State Law."
Basin Resources Inc. currently possesses such a certificate, for a
general aggregate limit amount of $2,000,000.00. This policy will
continue to remain in force through the life of the mine permit.
Thank you for providing your latest letter to our offices
for any further assistance we may provide.
Daniel I.
