We will request from the permittee the information you discuss regarding <br />subsidence monitoring that may have been conducted on your property. As <br />the room-and-pillar operations associated with the First North Main <br />stopped 350 feet from your residence and the rate of mining at that time <br />was less than 350 feet per month, the subsidence monitoring required per <br />Permit Stipulation No. 28 had yet to commence. We will be glad to submit <br />to you a copy of any survey data we receive. <br />5. Regarding your inquiry into a bond being posted for the well and the <br />surface damage at the mine airshaft, the Division approved Technical <br />Revision No. 15 on November 27, 1990, with an associated reclamation bond <br />increase of $17,421.27. This occurred apparently prior to your <br />discussions with KN Energy regarding your well in April of 1991. <br />Rule 2.03.9(1) discusses public liability insurance that permittees are <br />required to maintain for the life of their operation. A certificate <br />certifying that a policy for the insurance is in force shall, according <br />to the rule, "Provide for personal injury and property damage protection <br />in an amount adequate to compensate any persons injured or property <br />damaged as a result of surface coal mining and reclamation operations, <br />including use of explosives, and entitled to compensation under the <br />applicable provisions of State Law." <br />Basin Resources Inc. currently possesses such a certificate, for a <br />general aggregate limit amount of $2,000,000.00. This policy will <br />continue to remain in force through the life of the mine permit. <br />Thank you for providing your latest letter to our offices <br />for any further assistance we may provide. <br />Daniel I.
