We wish to provide the following responses. <br />Thank you for the photograph identifying your well's location relative to <br />the Golden Eagle Mine's airshaft. We will measure the well distance, <br />hill slope angles, and direction from the airshaft and place the location <br />of your well relative to the airshaft on our maps. Map 1 "Surface <br />Ownership" for the Golden Eagle Mine, submitted to us on March 6, 1990, <br />has a well symbol located in the vicinity of your well, but it's placed <br />within the property boundaries of the landowner to the east of your <br />property (Charon), <br />As we indicated in our letter of November 4, 1993, your well was <br />identified by Wyoming Fuel in their 1988 Water Users Survey as <br />non-functioning. As such, while the well's yield immediately prior to <br />the construction of the airshaft continues to be an issue, the existence <br />of the well appears documented by Wyoming Fuel in 1988 and 1990. <br />2. Thank you for also bringing to our attention testimony by Basin Resources <br />regarding the improper casing of the airshaft by Wyoming Fuel, the <br />previous permittee. Please provide a copy of that testimony, for our <br />review. Having such evidence may assist us in determining the extent of <br />any impact by the airshaft on local aquifers, and specifically your well. <br />3. In February of 1993, we informed the Air Pollution Control Division of <br />the Colorado Department of Health regarding your concerns with impacts to <br />your vegetation being caused by the Golden Eagle Mine exhaust fan. We <br />will bring your concerns to their attention again, as they have <br />apparently not responded to your requests. However, we also recommend <br />that you again contact them directly.
