Dennis Byrnes <br />Albuquerque Field Office <br />Office of Surface I4ining <br />625 Silver Avenue SW, Suite 310 <br />Albuquerque, 11ew Mexico 87102 <br />RE: Canadian Strip Mine, File C-81-026 <br />Dear Mr. Byrnes: <br />Based on our conversation yesterday, concerning bond adjustment activities <br />which occurred in 1987 vrith regard to the Canadian Strip Ptine, I would like to <br />provide the following information: <br />1. On July 14, 1986 Wyoming Fuel Company (WFC) submitted a technical <br />revision request (TR-03): which proposed immediate commencement of <br />final reclamation for the entire disturbed area. Pre viously the <br />mine had been in temporary cessation. At that time the disturbance <br />consisted of a large open pit, spoil piles, stockpiles, and support <br />facilities. This revision was approved by the Division on <br />September 30, 1986. The existing bond of 5921,000 vras not affected <br />by this revision. <br />2. On August 7, 1986 YIFC submitted their application for permit <br />renewal. The renewal application reflected the reclamation plan as <br />approved in TR-03. During the renewal process, permit C-81-02b was <br />converted to a reclamation only permit at YlFC's request. WFC had <br />planned on mining a large area to the south of the existing <br />disturbance. Mining of that area had been approved in the previous <br />permit term and vras included as part of the worst case disturbance <br />which led to calculation of the bond at 5921,000. With the <br />renewal, mining plans and approval for all undisturhed areas were <br />withdravrn. Therefore, after the renewal, worst case disturbance <br />was limited to the disturbance at that time. In accordance with <br />Rule 3.02.2(4) the amount of the performance bond was <br />recalculated. At that time 5746,45D vras required to cover worst <br />case disturbance. On 11ay 16, 1987 the permit renewal application <br />was approved as a reclamation only permit with a required bond <br />amount of 5746,450. <br />3. Based on this renewal decision and in accordance with Rule 3.03.2 <br />WFC submitted a request for reduction of excess liability. This <br />application vras deemed complete after submittal of additional <br />information on March 31, 1987. A prooosed decision was issued on <br />July 15, 1987 to approve the reduction.
