Dennis Byrnes Albuquerque Field Office Office of Surface I4ining 625 Silver Avenue SW, Suite 310 Albuquerque, 11ew Mexico 87102 RE: Canadian Strip Mine, File C-81-026 Dear Mr. Byrnes: Based on our conversation yesterday, concerning bond adjustment activities which occurred in 1987 vrith regard to the Canadian Strip Ptine, I would like to provide the following information: 1. On July 14, 1986 Wyoming Fuel Company (WFC) submitted a technical revision request (TR-03): which proposed immediate commencement of final reclamation for the entire disturbed area. Pre viously the mine had been in temporary cessation. At that time the disturbance consisted of a large open pit, spoil piles, stockpiles, and support facilities. This revision was approved by the Division on September 30, 1986. The existing bond of 5921,000 vras not affected by this revision. 2. On August 7, 1986 YIFC submitted their application for permit renewal. The renewal application reflected the reclamation plan as approved in TR-03. During the renewal process, permit C-81-02b was converted to a reclamation only permit at YlFC's request. WFC had planned on mining a large area to the south of the existing disturbance. Mining of that area had been approved in the previous permit term and vras included as part of the worst case disturbance which led to calculation of the bond at 5921,000. With the renewal, mining plans and approval for all undisturhed areas were withdravrn. Therefore, after the renewal, worst case disturbance was limited to the disturbance at that time. In accordance with Rule 3.02.2(4) the amount of the performance bond was recalculated. At that time 5746,45D vras required to cover worst case disturbance. On 11ay 16, 1987 the permit renewal application was approved as a reclamation only permit with a required bond amount of 5746,450. 3. Based on this renewal decision and in accordance with Rule 3.03.2 WFC submitted a request for reduction of excess liability. This application vras deemed complete after submittal of additional information on March 31, 1987. A prooosed decision was issued on July 15, 1987 to approve the reduction.
