-28- <br />The proposed design for the East dump calls for subtle, less than 5:1 <br />(horizontal to vertical) slopes. "Tne general land form of the East dump will <br />be that of a rounded mound some 200 yards northeast of where a natural rounded <br />mound stood before mining" (Page 11, Appendix J). <br />Rule 4.14.2 specifically requires that all areas affected by surface mining <br />operations shall be returned to their approximate original contour. The <br />applicant proposes to restore the mine site to approximate original contour. <br />The Division has evaluated the relocation of a minor ridge by 200 yards and <br />has determined that the resulting post~nining topography meets the <br />requirements of approximate original contour. <br />The operation is in compliance with the requirements of this section. <br />XVIII. Coal Processing Waste and Non-Coal Processing Waste - Rules <br />The Division has reviewed the application for compliance with these sections. <br />Information is contained on page D-3a of the application. This operation will <br />not produce any coal processing waste. All non-coal waste will be <br />appropriately disposed of. <br />The operation is in compliance with the requirements of this section. <br />XX. Roads - Rules 2.05.3(3 )(c)(i) and 4.03 <br />The Division has reviewed the relevant sections of the permit application <br />(Section D, pages 6-9) for compliance. <br />The haul road at the mine is in two sections. The first section is an <br />upgraded BLM right-of-why 4732 feet long; the second is 2768 feet of new <br />road. The information contained in the application verifies that the <br />location, design, construction, drainage, surfacing, maintenance, and <br />reclamation of the roads were planned with the consideration of the design and <br />performance standards of Rule 4.03.1. <br />It should be noted that Rule 4.03.1(4) contains specific designs for the <br />spacing of culverts on haul roads. The applicant is in compliance with the <br />spacing requirements, with the exception of the first 3300 feet of the haul <br />road. The Division has granted a variance from the requirements of rule <br />4.03.1(4)(e)(vi) for this road segment. The decision was based on the <br />following facts presented in the application: <br />
