-30- <br />Two areas of abandoned coal mining were present at the mine site prior to <br />commencement of operations in. 1979. One area was an incline and room <br />approximately 100 feet in extent (the McCallum mine), the other a small <br />excavation 20 x 30 feet at the outcrop of the Hoyle seam. Both are of small <br />extent. The Bourg operation mined through the McCallum mine in Stage I <br />operations and was completely backfilled. The small outcrop excavation was <br />mined through in Stage III of the mining operation and will be completely <br />backfilled. <br />The Division hereby conveys approval to mine through the outcrop mine on the <br />Bourg property. Upon examination, it has been determined by the Division that _ <br />this does not constitute an underground mine. Therfore, concurrent approval <br />of the mining by the applicant is not required of MSHA. This has been <br />confirmed by on-site investigations by MSHA. <br />Baseline and design information concerning the North gate loadout can be found <br />in Technical Revision No. 1, approved August 18, 1983. The operator <br />anticipates final reclamation of the loadout will be completed by the end of <br />1988. <br />The applicant has adequately addressed the topics of temporary and permanent <br />cessation of operations within the permit document. <br />The operation is in compliance with the requirements of this section. <br />XXV. aerations on Lands Subject to Limitations or Prohibitions - <br />. Rules '~2. <br />The Division has reviewed the information submitted by the applicant in <br />Section 2.03.7 and has determined the operation to be in compliance with the <br />requirements of this section and Rule 2.07.6(2)(d). <br />Pursuant to Rule 2.07.6(2 )(d ), the Division finds: <br />1) The permit area of the operation is not within an area designated as <br />unsuitable for mining, or an area under study for designation as unsuitable <br />for surface coal mining operations. The operation is not located within 300 <br />feet of any occupied building. <br />2) The operation is in compliance with the requirements of this section. <br />XXVI. Demonstration that Surface Coal Mining and Reclamation Operations <br />Pursuant to Rule 2.07.6 (2)(b), the Division finds that surface coal mining and <br />reclamation operations can be feasibly accomplished under the mining and <br />reclamation plan presented in the application. This finding is based on <br />information presented in the application and empirical and on-site evidence at <br />the Bourg Mine and two adjacent operations (Kerr Coal and Wyoming Fuel). <br />The operation is in compliance with the requirements of this section. <br />
