-26-
During the course of the initial permit review and in response to
Stipulation 4, the applicant provided an adequate discussion of the methods
and criteria to be used in evaluating revegetation success.
The applicant has proposed a revegetation seed mix composed of predominantly
native grasses, fortis, and shrubs, and provided the required justification for
the use of the introduced species in the seed mix.
The applicant has stated that no pest or disease control will be used on
site. Noxious weeds will be controlled according to Colorado State University
Extension Service recommendations. Weed control measures will be previously
approved by the Division before implementation.
The operator has committed to conducting a biennial revegetation monitoring
program. The details of the program are outlined in Walden Coal Company's
response to Stipulation 5 of the 1983 permit approval and in Section F of the
permit.
In several areas of the permit, the applicant has stated that Division
regulations will be superceded by Bureau of Land Management regulations with
respect to the haul road across Bureau of Land Management surface. The BLM
has agreed to accept Division requirements for reclamation and revegetation.
The applicant has stated that a complete reclamation plan for the haul road
will be submitted one year prior to the applicant's proposed abandonment of
that right-of-way.
The operation is in compliance with the requirements of this section.
XIII. The applicant has proposed several mitigation measures to insure that
detrimental effects to this species are minimized.
The existing power and telephone lines on site have been constructed to
minimize the hazard of raptor electrocution.
