<br />Cottonwood Farms <br />4. Source of Water (River and Tributary): <br />The water is tributary to the Cache La Poudre River and the <br />South Platte River. The water consists of surface runoff, <br />natural drainage, and seepage from Sections 29, 30, and 31 <br />of Township 7 North, Range 68 West, and Section 25, Township <br />7 North, Range 69 West. <br />5. A. Date of initiation of appropriation: November 27, 1901 <br />B. Date water first applied to beneficial use: on or <br />before November 27, 1901 <br />C. How appropriation was initiated: Appropriation was <br />initiated by the diversion of the water through the <br />East Rigden Flume and the use of the water to irrigate <br />farm land. <br />6. Amount Claimed: 10.6 c.f.s. absolute <br />7. Use or Proposed Use: Irrigation, commercial, industrial, <br />and augmentation. <br />Number of Acres Historically Irrigated: 119 <br />Legal Description of Acreage: 119 acres lying between the <br />Boxelder Ditch and the Fossil Creek Reservoir Inlet Ditch in <br />the West Half of Section 28, Township 7 North, Range 68 <br />West, excluding the South Half of the Southwest Quarter of <br />Section 28, Township 7 North, Range 68 West. See, Exhibit <br />A. <br />8. By the entry of a decree pursuant to this application, the <br />City of Fort Collins shall not be limited in its storm <br />drainage management practices nor is it obliged to guarantee <br />delivery of any storm drainage waters, so long as the <br />surface run off, natural drainage, and seepage which are the <br />subiect of this application are not permanently removed from <br />their natural drainage basin by the City of Fort Collins. <br />Nothing in a decree entered pursuant to this application <br />shall obligate Cottonwood Farms to accept any water from the <br />City of Fort Collins. <br />9. The applicant shall install and maintain such measuring <br />devises and maintain such records as the Division Engineer <br />may reasonably require for the administration of this right. <br />Any records shall be furnished to the Division Engineer upon <br />request. <br />l0. The priority herein awarded to the East Rigden Flume was <br />filed in Water Court in 1989, and shall be administered as <br />a\cozFnn.c <br />-2- <br />
