Rule 2.04.11 - Fish and Wildlife Resources Information <br />The comments made by Mr. James L. Aragon, District Wildlife Manager with <br />the Colorado Division of Wildlife, relate to information required to <br />receive exploration drilling permit, Notice of Intent C-87202-00, which <br />covered 359.45 acres and not the 2 acre permit as claimed by "TREND". <br />Mr. Aragon's letter of October 17, 1990 to Michael Ossola of the <br />Las Animas County Planning Office, further indicates that there are no <br />known threatened or endangered species in the proposed permit area and <br />that overall impact of the proposed project to wildlife in the are would <br />be minimal. <br />Rule 2.05.3(4) - Ponds, Impoundments and Diversions <br />The sediment pond and diversion ditches were designed in accordance with <br />Rules 4.05.3 and 4.05.6. Our evaluation of the applicant's runoff and <br />sedimentation projects did consider the impact of revegetation and soil <br />disturbance, and was based on worst case conditions during the permit <br />term. <br />Rule 2.05.3(91 - Underground Development Waste <br />No underground mining is proposed, consequently no underground <br />development waste will be produced. <br />Rule 2.05.4f2)e - Revegetation <br />This has been addressed under Rule 2.04.10. Refer to Map 5 in Volume II <br />of the permit application. <br />Rule 2.05.6 - Mitigation of the impact on mining operations <br />The Division has considered the mitigation of impacts for the whole <br />permit area. <br />Rule 2.05.6(1) - Air Pollution Plan <br />The air emission permit as stated above was renewed on October 9, 1990 <br />until April 1992. The application adequately addresses the requirement <br />of Rule 2.05.6(1). <br />Rule 2.05.6(2) - fish and Wildlife Plan <br />This has been addressed by the Division, all the disturbance that will be <br />associated with the mining operation was taken into account. The <br />Division of Wildlife has reviewed the plan and indicated that impacts to <br />wildlife would be minimal. <br />Rule 2.06.3 - Mountain top Removal Mining <br />This topic is not applicable because there is no mountain top removal <br />involved in the proposed permit application.
