10 acre-feet/yeaz projected by the augmentation plan, the U.S. Fish and Wildlife Service <br />has determined that no depletion fee is required from the Eastside Mine. The Colorado <br />Division of Wildlife requested that Eastside Mine contact them to verify reporting <br />requirements for the augmentation plan. The Division forwazded this request to Eastside <br />Mine. <br />15. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As <br />of this time, Eastside Coal Company, the operator, is current in the payment of reclama- <br />tion fees required by 30 CFR Chapter VII, subchapter R. (2.07.6(2)(0)). <br />Section B <br />The following findings and specific approvals are required by Rule 4: <br />I. Roads <br />A. Haul Roads <br />1. The major road construction during the life of the mine was the realignment <br />and lengthening of the haul/access road from County Road 237 to the portal <br />azea. The road design meets regulatory requirements for vertical and <br />horizontal alignment, cut slopes, embankments, and drainage. Cut and fill <br />slopes were revegetated upon completion of construction. The road will not <br />be reclaimed but will remain following final reclamation to provide access <br />to the site as requested by the landowner (see Appendix G of the <br />application). <br />The proposed operation is in compliance with the requirements of this <br />section. <br />2. The Division proposes to approve the retention of the haul road, as it is <br />compatible with the approved post-mining land use, and a request for its <br />retention was submitted by the landowner (see Appendix G of the <br />application) (4.03.1(1)(f)(i)). <br />II. Support Facilities <br />A discussion of mine facilities is presented on pages 82 through 101 of the application. <br />Existing facilities used in the operation included the mine portals and yard area, <br />equipment storage area, sediment pond and an access road from County Road 237 to the <br />portal area. The application proposed realignment of the haul/access road, construction of <br />office/ship facilities neaz the junction of County Road 237 and the mine access road, <br />upgrading of the coal handling facilities (installation of a belt line and enclosed screening <br />facility), expansion of the coal stockpile area and construction of the underground waste <br />disposal area. None of these facilities were constructed because of the premature termina- <br />tion of the mining operation. The operation is in compliance with the requirements of this <br />section. <br />8 <br />
