Mautz -2- July 1, 1997 <br /> Fence - During the site inspection of May 21, 1997 , the inspection <br /> participants viewed portions of a damaged fence. This fence was the <br /> same fence viewed during the inspection of August 27, 1996 . On May <br /> 21, 1997 , the fence seemed to be in generally the same condition as <br /> was observed last August. The fence is also in an area of active <br /> and historic landsliding; therefore, it is not possible to <br /> conclusively attribute fence damage to mining. Regardless, Mountain <br /> Coal Company has offered to assist you in repairing the fence as <br /> documented in their letter to you dated June 23 , 1997 . We <br /> encourage you to work with Mountain Coal Company to accomplish any <br /> needed repairs. <br /> Other Structures - We are not aware of any other structure <br /> possibly subject to damage from subsidence except the cabin in <br /> Section 20 . This cabin was inspected several times by the DMG, most <br /> recently on August 29, 1996 . Our conclusions were documented, and <br /> the report was forwarded to you last year . Cabin repairs were <br /> conducted by Mountain Coal Company. We also understand that on <br /> November 11, 1996, Mountain Coal Company provided you a check in <br /> the amount of $4, 000 . 00 to compensate you for the damage that may <br /> have occurred as a result of mining. It is our understanding that <br /> the money was accepted by you, and therefore, that compensation has <br /> occurred. <br /> Rockfall - During the inspection of May 21, 1997 , it was verified <br /> that rockfall is occurring in the area referenced in your letter to <br /> Mountain Coal Company dated May 19, 1997 . The DMG also took aerial <br /> photographs of the area. The rockfall area appears to be located <br /> in an historic landslide area. Mining may have accelerated some of <br /> the landslide processes already occurring in this area, and this <br /> possible impact is an expected occurrence . We are not aware of any <br /> structures jeopardized by this landslide area. We strongly advise <br /> that people and stock be prevented from entering any area which is <br /> subject to active landsliding and rockfall . Mountain Coal Company <br /> has offered to sign and fence the area, by letter to you dated May <br /> 20, 1997 , and by letter to the DMG dated June 23 , 1997 (copy <br /> enclosed) .
