<br />Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to approve with stipulations an <br />application from the Pittsburg and Midway Coal Mining Company (P&M) for a permit <br />renewal at the Edna Mine. This decision is based on a finding that the operations will <br />comply with all requirements of the Colorado State Program as found in the Colorado <br />Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations <br />promulgated pursuant to the Act. If no request for a formal hearing is made within thirty <br />(30) days of the first publication of the issuance of this proposed decision, then this <br />decision becomes final. The permit application, all supporting documentation and any <br />stipulations or conditions will become a binding part of the permit. <br />The following stipulation is the only one in effect for the Edna Mine. <br />WATER FROM NPDES POINT 007 WILL NOT BE USED AS SURFACE <br />IRRIGATION WATER UNLESS THE OPERATOR FIRST DEMONSTRATES AND THE <br />DIVISION FINDS THAT IRRIGATION WTI'Ii THAT WATER WII.L NOT RESULT IN <br />MATERIAL DAMAGE. <br />The Division last made detailed findings of compliance for the Edna Mine with Permit <br />Renewal No. 3, approved October 16,1997. <br />Edna Mine 2 Permit Renewal No. 4 <br />
