<br />-39- <br /> <br />STIPULATION NO 13 <br />SIZING CALCULATIONS FOR THE ACCESS ROAD CULVERT SOUTH OF HIGHWAY 12 MUST BE <br />SUBMITTED WITHIN 30 DAYS OF PERMIT REVISION APPROVAL. <br />With the acceptance of the above stipulations the Division finds the proposed <br />operation in compliance with the requirements of this section. <br />XX. Bonding - Ruie 2.05.4(2)(b) <br />Bonding calculations were submitted by the applicant on March 6, 1984 in <br />response to the Division's completeness review. Additional calculations were <br />submitted on April 25, 1984 and May 21, 1984 in response to adequacy review <br />questions. These calculations can be found in the permit revision application <br />in Addendum A, C, and E. The Division has accepted the bond amount as <br />calculated by Wyoming Fuel Company. Therefore, the amount of additional bond <br />necessary to cover activities to be approved under this permit revision for <br />this five-year permit term shall be $435,218.00. <br />XXI. Subsidence -Rules 2.05.6(6) and 4.20 <br />Information concerning subsidence can be found on page III(19), and in <br />Addendum A of the permit revision application. The applicant has addressed the <br />potential impacts of ground subsidence upon the proposed coal processing waste <br />structure. Portions of the proposed waste disposal site were undermined by <br />the old New Elk Mine workings at a depth of from 320 to 900 feet. Recovery <br />within the workings was limited to less than 50%. An extensive longwall <br />subsidence study performed under contract to the U.S. Department of Energy, <br />has demonstrated subsidence above the New Elk Mine typically occurs relatively <br />quickly and manifest minimal differential settlement. The applicant concludes <br />" that any subsidence that may have resulted from past undermining (more <br />than 20 years ago) has already occurred and that additional subsidence <br />resulting from placement of the refuse pile would be minimal." The stability <br />of the refuse pile as designed should not be affected by subsidence. <br />Subsidence impacts to the backfilled stream channel will be the same as those <br />which would occur to the river valley. These impacts have been predicted to <br />be negligible and historic evidence provided by undermining of the valley <br />floor in the past verify this prediction. <br />The Division finds the proposed operation in compliance with the requirements <br />of this section. <br />XXII. Special Categories of Mining -Rules 2.06, 4.22, 4.23, 4.26, 4.21, 4.28 <br />and 4.29 <br />fie requirements of this section do not apply to this operation, since none of <br />the special categories of mining will be conducted. <br />xXIII. Miscellaneous Compliance -Rules 2.05.6(5), 4.02, 4.12, 4 <br />an <br />No problems were identified with respect to the requirements of these sections <br />during the review. Based on information provided in Vol. I of the <br />application, the operation is in compliance with all the requirements of the <br />ahnvP ceCt10n 5. <br />
