The permittee shall comply with all applicable conditions of Section 8.3.1 C (under General Requirements <br />checklist), and Section 8.3._1.4 (Coal Mining_Performance Standards, Requirements and Criteria). <br />2. The Special Use Permit is limited to uses and_facilities presented in the orig(nal project plari. Any <br />additional uses or facilities must be applied for in a new or amended application. <br />3. Any complaints or concerns that may arise-from this operation may be cause for review of the Special <br />Use Permit of any time, and amendment or addition of conditions, or revocation of the, permit, if <br />necessary. <br />4. The operator shall prevent the spread of eveetls to surrounding lands. A noxious weed management plan <br />approved by the Routt County Weed Supervisor shall be obtained. <br />5. In the event that Routt County commences an action to enforce or interpret this Special Use Permit, the <br />substantially prevailing party shall be entitled to recover its costs incurred in such action, including, <br />without (imitation, attorney fees.. <br />6. Nojunk, trash or inoperative vehicles shall be stored or allowed to remain on the property. <br />7. This permit is contingent upon permits being obtained and kept current for air and wafer emissions, <br />reclamation, and other appropriate permits from all im~olved agencies. These include, but are not limited <br />fo: Division of Minerals and Geology Permit and Colorado Department of Health Air Pollution Emission <br />Notices. <br />
