<br />I . The results of the drilling program, as referenced in the Colorado Division of Water Resources letter <br />to the Division, dated February 9, 2001, including installation of piezometers or other down-hole <br />instrumentation. <br />2. The results of the seismic investigation and evaluation of the structure, including recommendations <br />for any additional instrumentation. <br />3. The installation of any additional monitoring instrumentation, seismic or otherwise, in accordance <br />with the final instrumentation plan. <br />4. A report of all baseline data and a description of the baseline conditions within a 1 mile radius of the <br />dam. <br />5. A final report and impact analysis prior to anticipated mining with a projected angle of draw <br />that is within one mile of the dam, <br />Stipulation No. 10 <br />Prior to affecting USDA-Forest Service (FS) water rights by mining, the Operator will submit to the <br />Division for approval, a technical revision that includes 1) a revised Map 23, "Water Rights Location" <br />and revised text that describe the FS water rights within the permit and adjacent area, and 2) verification <br />that acourt-approved water augmentation plan is in effect for those FS water rights within the permit and <br />adjacent area that may be contaminated, diminished or interrupted by mining. <br />Stipulation No. 14 <br />Bowie Resources must submit verification to the Division that the Colorado Division of Wildlife concurs <br />with the proposed plan concerning the woody plant stem density standard for those areas to be reclaimed <br />at the Bowie No. 2 Mine. <br />SUMMARY <br />The Review Process <br />The Bowie No. 2 Mine permit application was submitted by Bowie Resources Limited on February 13, <br />1996. The permit application was deemed complete on February 23, 1996, and the required agency <br />notification letters were sent by the Division. Comments were received from the Colorado Division of <br />Wildlife, the Colorado State Engineers' Office, the United States Army Corps of Engineers, the United <br />States Office of Surface Mining, the United States Fish and Wildlife Service, the Colorado State Historic <br />Preservation Office, and the Colorado Department of Transportation. <br />The Division sent adequacy letters to Bowie Resources Limited on May 31, 1996, June 21, 1996, August <br />9 1996, November 18, 1996, November 2Q 1996, December 27, 1996, January 29, 1997, February 18, <br />1997 and February 19, 1997. All Division adequacy letters were answered by BRL. With the exception of <br />those issues which were stipulated with the approval, all technical and procedural issues were resolved. <br />The permit was issued on April 4, 1997, with an expiration date of Apri14, 2002. <br />The original proposal to construct facilities in support of a longwall was submitted by BRL in Technical <br />Revision No. 6. Technical Revision No. 6 was submitted on December 7, 1998 and proposed to construct <br />
