Drav Clarification <br />page 2 <br />that, while I did not specifically remember the Golden Eagle <br />mine's subsidence parameters, angles of draw determined for <br />Colorado underground coal mines with low stratigraphic dips <br />commonly fall in the range from 23° to 27°. I also recollect <br />mentioning that extensive subsidence observations had been <br />performed by the U.S. Bureau of Mines over longwall test <br />panels mined in the Golden Eagle mine (previously the C, F & <br />i Maxwell mine). i offered these comments in the spirit of <br />cooperation with the intention of assisting people's <br />comprehension of the situation. It is disappointing to <br />realize that Mrs. Tatum has seen fit to suggest that my <br />statements should be used to impeach. <br />(2) "Daniel Harnandez on August 12, 1993, calculated the angle of <br />draw at 30°." <br />Mrs. Tatum's reference is apparently directed at a letter from <br />Dan Hernandez to Mr. Michael A. Ossola of the Las Animas <br />County Planning and Land Use Office, dated August 12, 1993. <br />In the fourth full paragraph on page 2 of that letter Dan <br />"calculates" the width of the potential subsidence halo in <br />order to determine whether the Tatum's house was included <br />within the projected area potentially effected by subsidence <br />of the Golden Eagle workings. Dan did not "calculate" the <br />angle of draw. Dan used the 30° value for the angle of draw <br />contained within the revised permit documents for the Golden <br />Eagle mine (page 2.05-58, subsequently revised 05-18-94). <br />(3) "I have been advised that Jim Pendleton testified at hearings <br />in 1994, with reference to the Baldwin property, that the <br />angle of draw was 35°." <br />I would recommend to Mrs. Tatum that she be careful about <br />relying upon hear say. To the best of my recollection I did <br />not testify at any of the hearings addressing Golden Eagle <br />mine concerns during the year of 1994., I did, however, advise <br />Joe Dudash of our staff concerning the Raton West - Baldwin <br />Ltd. / Basin Resources controversy regarding potential <br />subsidence impacts to the Rancho Escondido development. As a <br />portion of that consultation I drafted a memorandum to Joe <br />dated January 19, 1994. Within that memorandum (Paragraph 2, <br />page 2) I presented the following recommendation to Joe: <br />"Until they [Basin Resources] complete the determination of a <br />more precise angle of draw I recommend that you use 35 degrees <br />in determining whether proposed extraction might potentially <br />impact any structures in Rancho Escondido." I recommended <br />this assumed angle of draw with the understanding that it was <br />
