Ahrng, ~0, a former <br />asphalt plant manager for B&B <br />Excavating is accused of instruct- <br />ing nvo employees to dump <br />weed-killer into road-base mate- <br />rials.'The materials were used to <br />make asphalt and later poured <br />onto a roadway. <br />The charge follows a lengthy <br />investigation by the Environmen- <br />tal Protection Agency that started <br />last winter when a former B&B <br />employee tipped off the agency <br />to an environmental violation. <br />According to the EPA report, <br />Ahring told two employees to <br />dump two, 55-gallon cans of <br />Repro Kill 11, aweed-killer, into <br />road-base materials. The mixture <br />was later processed into road <br />asphalt at the B&B-operated <br />Montgomery Pit east of Gypsum. <br />Suspicion arose when employ- <br />ees working with the asphalt <br />complained of funny-smelling <br />fumes. The operation was shut <br />down and an anonymous report <br />was filed with the EPA. The <br />report dues not say where the <br />asphalt was poured, said Michael <br />Goodbee, 5th Judicial District <br />Attorney. <br />The investigative report does <br />say that Ahring was immediately <br />suspended while the company <br />looked into the allegations. The <br />company volunteered to shut <br />down the asphalt plant, and <br />Ahring was later bred. <br />Tests on the asphalt revealed <br />low concentrations of the weed- <br />killer, which consists of more <br />than 90 percent diesel fuel, <br />according to a report from Dames <br />and Moore, an environmental <br />engineering firm. The concentra- <br />tion found in the asphalt was <br />below hazardous levels, accord- <br />ing to the EPA report. <br />Prolonged contact to the <br />weed-killer can irritate the skin, <br />nose and throat. Goodbee said <br />the EPA would have advised his <br />office if the weed-killer had <br />posed a public threat after it ryas <br />used on the roads. <br />Goodbee filed the charges <br />against Ahring Aug. 23. <br />"I don't know why he did it;' <br />Goodbee said. Nor does the <br />report explain why Ahring had <br />the wed-killer, Goodbee added. <br />Goodbee said he will not <br />charge B&B Excavating because <br />he does not have evidence to <br />believe that any higher-ups were <br />aware of or consented to <br />Ahring's actions. <br />Goodbee added that Ahring <br />was cooperative during the <br />course of the investigation. <br />The charge against Ahring is a <br />class 4 felony and is punishable <br />by two to six years in prison and <br />up to $500,000 in fines, Goodbee <br />said. <br />Alleged assault leads to arrest <br />Mrac Baroni -- <br />Vail Daily Siaf'F Writer <br />EDWARDS - Bernardo <br />Romero was arrested early Satur- <br />day morning on three charges, <br />including asecond-degree felony <br />assault against a police officer, <br />according to Eagle County Sher- <br />"We had a report of a suspi- <br />rious 0ehicle doing donuts in the <br />center of Highway 6 in front of <br />the Eagle River Trailer Park, and <br />when 1 arrived there, two indi- <br />viduals were by the car;' O'Sulli- <br />van said.
