Ahrng, ~0, a former asphalt plant manager for B&B Excavating is accused of instruct- ing nvo employees to dump weed-killer into road-base mate- rials.'The materials were used to make asphalt and later poured onto a roadway. The charge follows a lengthy investigation by the Environmen- tal Protection Agency that started last winter when a former B&B employee tipped off the agency to an environmental violation. According to the EPA report, Ahring told two employees to dump two, 55-gallon cans of Repro Kill 11, aweed-killer, into road-base materials. The mixture was later processed into road asphalt at the B&B-operated Montgomery Pit east of Gypsum. Suspicion arose when employ- ees working with the asphalt complained of funny-smelling fumes. The operation was shut down and an anonymous report was filed with the EPA. The report dues not say where the asphalt was poured, said Michael Goodbee, 5th Judicial District Attorney. The investigative report does say that Ahring was immediately suspended while the company looked into the allegations. The company volunteered to shut down the asphalt plant, and Ahring was later bred. Tests on the asphalt revealed low concentrations of the weed- killer, which consists of more than 90 percent diesel fuel, according to a report from Dames and Moore, an environmental engineering firm. The concentra- tion found in the asphalt was below hazardous levels, accord- ing to the EPA report. Prolonged contact to the weed-killer can irritate the skin, nose and throat. Goodbee said the EPA would have advised his office if the weed-killer had posed a public threat after it ryas used on the roads. Goodbee filed the charges against Ahring Aug. 23. "I don't know why he did it;' Goodbee said. Nor does the report explain why Ahring had the wed-killer, Goodbee added. Goodbee said he will not charge B&B Excavating because he does not have evidence to believe that any higher-ups were aware of or consented to Ahring's actions. Goodbee added that Ahring was cooperative during the course of the investigation. The charge against Ahring is a class 4 felony and is punishable by two to six years in prison and up to $500,000 in fines, Goodbee said.
