-84- <br />XIX. Roads - Rules 2.05.3(3) and 4.03 <br />The existing haul road at the Bear No. 1 and No. 2 will be reclaimed and associated <br />culverts will be removed as a part of reclamation during the summer of 1982. <br />Proposed roads at the Bear No. 3 are discussed on pages 4.03-1 through 4.03-3 of the <br />Bear No. 3 application. One main haul/access road will extend approximately '~ mile <br />from the stockpile and facilities area, across an existing bridge over the North Fork, <br />to Highway I33 at Somerset. The road has been reviewed by the Division, and will <br />meet the design and construction requirements of Rule 4.03. Bear proposes to utilize <br />an existing portal access road extending approximately 300 feet at the site of the <br />Bear No. 3 mine, in order to access the proposed modified portal facilities. As detailed <br />here above, within Section XVII, "Backfilling and Grading", the applicant <br />has submitted a preliminary report of geotechnical investigation and stability analysis <br />of the proposed portal access road and portal facilities at the Bear No. 3 mine. <br />With the imposition of those stipulations, the Division finds the applicant's plan <br />for the construction of the portal access road to be in compliance with the requirements <br />of the permanent program regulations. <br />A common operational problem at Western Colorado mines is road and ditch maintenance <br />during the winter, specifically disposal of snow which is cleared from road surfaces <br />and other surface facilities areas. The following stipulation is necessary; <br />STIPULATION NO. 14: <br />WITHIN TWO MONTHS OF PERMIT ISSUANCE, THE PERMITTEE WILL SUBMIT TO SHE DIVISION <br />AN ACCEPTABLE PLAN FOR SNOW REMOVAL AND DISPOSAL, TO INSURE THAT SNOW AND ROAD <br />SURFACING MATERIAL IS DISPOSED OF IN AN APPROPRIATE AREA, AND DOES NOT INTERFERE <br />WITH SURFACE DRAINAGE. <br />
