Coal Processing G7aste and Non-Coal f'rocessing Waste - Rules 2.05.3(8), <br />2.05.4(2)(f), 4.10, and 4.11 <br />No coal processing waste or non-coal processing waste is produced by the Bear <br />operations, since coal is not subjected to chemical or physical processing. Initial <br />plans for the Bear No. 3 referenced the use of a rotary breaker for separating rock <br />from coal, however the application was later amended to indicate that a rotary crusher <br />would be substituted for the rotary breaker facility due to the absence of rock within <br />the C coal seam. <br />The applicant has not addressed the storage and final disposal of non-coal wastes such <br />as grease, oil, paints, fla;runable liquids, abandoned mining machinery, and lumber as <br />required by Rule 4.11.4. The following stipulation is required; <br />STIPULATION NO. 12: <br />WITHIN ONE_M_ONTH OF PERMIT ISSUANCE, THE PERMITTEE WILL SUBMIT A PLAN T_O <br />THE DIVISION FOR PLACEMENT AND STORAGE OF ALL NON-COAL WASTES IN A <br />DESIGNATED PORTION OF THE PERMIT AREA TO ENSURE THAT LEACHATE AND SURFACE __ <br />RUNOFF DO NOT DEGRADE SURFACE OR GROUND WATER. R PLAN FOR FINAL DISPOSAL <br />OF NON-COAL WASTES IN A DESIGNATED DISPOSAL SITE WILL ALSO BE SUBMITTED. <br />
