Hydrologic Balance: Surface water - Rules 2.04.5, 2.04.7, 2.05.3, 2.05.6 <br />For a description of the surface water hydrology of the mine area and a discussion <br />of the impacts of mining on surface water, refer to the Surface Water Hydrology <br />portion of Section IX, Probable Hydrologic Consequences and Cumulative Impact <br />Assessment of this document. <br />The surface water hydrology information, sediment control and protectionof the hydro- <br />logic balance sections of the application have been reviewed by the Division. The <br />surface water information sections can be found on pages 47-1a through 49 of the <br />Bear No. 1 and No. 2 application, and pages 2.04-31 through 2.04-33 of the Bear No. 3 <br />application. Drainage and sediment control text, plans and calculations are presented <br />on pages 62 through 65 of the first application, and 2.05-22 through 2.05-23 and <br />in Exhibit lI of the second application. <br />In the P.A.R. of May 15, 1981, the Division noted a number of problems regarding <br />sediment and drainage control for the Bear No. 1 and No. 2 portals and facilities <br />area. As noted in the Division's adequacy letter of January 18, 1982, a remaining <br />concern is the sediment control Treasures to be employed following the Highway <br />Department's relocation project which will impact sedimentation ponds No. 2 and No. 2. <br />In a meeting on August 24, 1981, involving representatives of the Bear Coal Company, <br />the Division and the State Highway Department, the problems resulting from the Highway <br />L~parttrent's proposed highway and river channel relocation project through the Bear <br />permit area were discussed. Beginning in the spring of 1982, relocation of Colorado <br />Highway 133 will bring the highway through a major portion of the Bear No. I and <br />No. 2 loadout facilities. River channel relocation associated with the highway <br />project will move the North Fork of the Gunnison closer to the Bear No. 1 and No. 2 <br />facilities area. The project will remove sediment pond #1, north of the river, and <br />sediment pond #2, south of the river. Bear Coal Company has requested an exemption <br />from the sediment pond requirements for the areas currently controlled by ponds #1 <br />and #2. <br />Pursuant to Rule 4.05.2(3), the Division is granting the requested exemption. The <br />affected area is small, Iess than 10 acres, and relatively level. All surface <br />facilities will be removed, coal material disposed of and the site regraded, top- <br />soiled and seeded by the fall of 1982. Immediately following topsoiling, the site <br />will be stabilized with straw mulch. The reseeded vegetation stand will provide <br />erosion protection in succeeding years. For these reasons, the Division finds that <br />sedimentation ponds are not necessary for the drainage to meet the effluent limitations <br />of Rule 4.05.2. Reconstruction of sediment ponds would create additional disturbance <br />in the reclaimed area. There will be no mixture of surface drainage with <br />discharge from underground mine workings. The runoff conditions for these sites <br />will be closely monitored by the company and the Division through regular inspections. <br />If field inspections find that problems with sediment is occurring, then mitigation <br />measures will be undertaken. <br />The only other remaining surface water concern with respect to the Bear No. 2 and <br />No. 2 mines is that regrading operations restore the natural drainage patterns in <br />the reclaimed area. In the P.A.R, of May I5, 1982, the Division stated that although <br />page 62 of the application indicated that no alteration of natural drainageways <br />had occurred at the Bear Mine, the plan referenced a permanent diversion in Figure <br />2.09.3(2)(q)-1.
