Fish and Iildlife - Rules 2.O,.il, 2.05.6(2), and 4.18 (con't)~. <br />Divisior. staff has consulted with Division of 1•'ildlife (DOif) personnel, who <br />are familiar with the area. both agencies agree that there is little <br />potential _`er adverse effects of the mire on wildlife since nearly all of the <br />anticipated surface disturbance has occurred and a very limited area is <br />affected. <br />Pursuant to Pule Z.Oi.6(2)(n) and on the basis of available information, the <br />Division finds that the proposed activities ccill not affect the continued <br />existence of endangered or threatened species or result in the destruction <br />or adverse modification of their critical habitats. <br />}:IC. Prime Farmland - Pules 2.04.12, 2.06.6, and 4.25 <br />The applicant has provided a discussion pertaining to the e>istence of prime <br />farmland at McClane Cam~on in Section 4.1.2.4 of the application. The Soil <br />Conservatier. Service has issued a negative determination or. the presence cf <br />prime farmland within the permit area (see Appendix L, \'elume It' of the <br />application). <br />The applicant has satisfactorily demonstrated that no prime farmland exists <br />t~~ithin the permit area. The Division finds the proposed operation ir. <br />compliance with Rule 2.Oi.612)(k). <br />~1'. Operations Description - Rules 2.05.2. 2.05.3(1). 2.05.3(2). and ~.0 <br />A description of the general operations plan for the ?ScClane Canyon ?line is <br />given in Section 2. 0, ~~olume I of the application. The applicant intends to <br />advance mining into the graben during the ne>:t three years to determine the <br />feasibility of mining beyond this periit term. <br />The operation is an underground mine removing coal using room and pillar <br />techniques. Total life of the operation caill depend on an assessment of <br />recoverability of coal which will be determined as mining progresses. <br />Appriximately 123,800 tons of coal will be removed frem~ the mine per gear. <br />The total anticipated product is 369,500 tons over the three year permit <br />ter:. Approximately 7,7 acres of surface distur'oance will occur during the <br />per.it term. <br />T_he U.S. Geological Survey, has reviewed the ?•1cClane Canvor. ?line Plan for <br />compliance with the ?lineral Leasing Act anc the 30 CFR 211 regulations. <br />The agency has found the mine plan to be in compliance with the ?fineral <br />Leasing Act (see Memorandur,. to Assistant Secretary for Energy and ?finerais). <br />:,1'I. backfilling and Grading. - Rules 2.05.3(6)(b). 2.05.=(2)(a), 2.05.4(2 <br />4.09. 4.13, and 4.14 <br />:. description of the bac}:filling play. for the McClane Car.von ?fine is presented <br />in Section 3.1 of the application. because the mine is an undercrour.d mine, <br />only a limited aria of surface disturbance will require backfilling and grading. <br />
