The Division finds that the Right of Entry and Operation Information required <br /> by Section 2.03.6 has been properly submitted, reviewed, and deemed <br /> adequate under Section 2.08.6(2)(b)(iii). <br /> 6. The Division finds that the Waiver Information required by Section 2.03.7(3) <br /> has been properly submitted, reviewed, and deemed adequate under Section <br /> 2.08.6(2)(b)(iii). <br /> 7. The Division finds that the Personal Injury and Property Damage Insurance <br /> Information required by Section 2.03.9 has been properly submitted, reviewed, <br /> and deemed adequate under Section 2.08.6(2)(b)(iii). <br /> 8. The Division finds that the Identification of Other Licenses and Permits <br /> required by Section 2.03.10 has been properly submitted, reviewed, and <br /> deemed adequate under Section 2.08.6(2)(b)(iii). <br /> 9. The Division finds that, based upon all available information, Oxbow Mining, <br /> Inc. and all related owners and controllers of said company are currently in <br /> compliance with Sections 2.07.6(1)(b) and 2.07.6(1)(c). <br /> The Applicant Violator System (AVS) was queried by the Division on <br /> December 2, 1997, December 22, 1997, and January 22, 1998. The <br /> evaluations resulted in AVS recommendations to approve Oxbow Mining, Inc. <br /> as the successor operator for Permit No. C-81-022. The Office of Surface <br /> Mining Regulation and Enforcement(OSMRE) recommendations subsequent <br /> to each AVS query also recommended approval of the transfer application. <br /> 10. The Division finds that the application for transfer and succession <br /> demonstrates compliance with Section 2.07.6(2). <br /> 11. The Division finds that, based upon representations of Oxbow Mining, Inc., <br /> operations will be conducted in full compliance with the terms and conditions <br /> of the original permit in accordance with the requirements of the Act and the <br /> Sections 2.08.6(4)(c). <br /> Decision <br /> The Division hereby proposes to approve the Request for Transfer of Coal Permit and <br /> Succession of Operators for Permit No. C-81-022, from Oxbow Carbon & Minerals <br /> Inc. to Oxbow Mining, Inc.
