This document contains the findings and proposed decision pertaining to a Request <br /> for Transfer of Coal Permit and Succession of Operator. The request was received <br /> by the Division of Minerals and Geology (the Division) on October 28, 1997, and <br /> proposes a transfer of DMG Permit No. C-81-022 from the current permittee and <br /> operator, Oxbow Carbon & Minerals, Inc., to Oxbow Mining, Inc. The application was <br /> submitted and reviewed pursuant to the procedures of Section 2.08.6 of the <br /> Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. The <br /> Division proposes to approve the request for transfer and succession. <br /> Process <br /> On October 28, 1997, the above-referenced application was received by the Division. <br /> This initial application was a properly executed Request for Transfer of Coal Permit <br /> and Succession of Operators Form, as required by Section 2.08.6(2)(b). The <br /> application was deemed complete for purposes of filing on January 23, 1998. As <br /> required by Section 2.08.6(3), the Division received an Affidavit of Publication <br /> indicating that the public notice had been published in the Delta County Independent <br /> on November 12, 1997. <br /> The Division sent an initial adequacy letter to Oxbow Carbon and Minerals, Inc. on <br /> December 3, 1997 with concerns regarding identific f interests. On January 13, <br /> 1998, the Division received a replacement Coal Reclamation Bond in the form of <br /> Corporate Surety # 11 om the Frontier Insurance Company, in the amount of <br /> $2,308,461.00.This bond replaced Ox bon and Minerals, Inc. Letter of Credit <br /> # 003511. On January 14, 1998, the properly executed bond document Frontier <br /> Insurance Company Bond # 114425 was approved by the Division. On January 23, <br /> 1998, the Division received a certificate of liability insurance for Oxbow Mining, Inc. <br /> Adequacy concerns with the insurance certificate were transmitted to Oxbow Mining, <br /> Inc. on an ongoing basis.A revised certificatewas received on January 23, 1998, and <br /> found to be acceptable.This proposed decision to approve the application for transfer <br /> and succession is being issued on January 23, 1998. <br /> Findings <br /> 1. The Division finds that a properly executed Request for Transfer of Coal Permit <br /> and Succession of Operators application form has been submitted to the <br /> Division in compliance with Section 2.08.6(2)(b). <br /> 2. The Division finds that properly executed Coal Reclamation Bond has been <br /> posted by the successor operator and approved as follows: <br /> Frontier Insurance Company Corporate Surety # 114425 for <br /> $2,308,461.00. <br /> 3. The Division finds that the Identification of Interests information required by <br /> Section 2.03.4 has been properly submitted, reviewed, and deemed adequate <br />
