-4- <br />®~~~ <br />SUMMARY <br />Empire Energy Corporation is applying fora permit revision and technical <br />revision under the Colorado Surface Coal Mining Reclamation Act. The permit <br />revision application is a request to allow mining in the Eagle No. 9 Mine and <br />the technical revision application is a request to increase the permit <br />boundary of the Eagle No. 5 Mine. <br />This document amends the findings document for the Eagle Mines No. 5 and No. 9 <br />that was dated September 2, 1983. At that time, the Division partially <br />approved the Eagle Mine No. 9. The partial approval limited the conduct of <br />surface coal mining and reclamation operations at the Eagle Mine No. 9 to <br />environmental monitoring and maintenance of existing surface facilities. <br />Findings of compliance could not be made in the sections of the findings <br />document addressing the Probable Hydrologic Consequences, Alluvial Valley <br />Floors, and Subsidence. The Eagle Mine No. 5 was found to be in compliance <br />and full approval was recommended. <br />On October 31, 1963, Empire Energy Corporation submitted a permit revision <br />seeking full approval for the Eagle Mine No. 9. The permit revision <br />application addressed the hydrologic and subsidence concerns that were <br />generated during the original permit application review. The Eagle Nine No. 9 <br />permit revision was deemed complete on November 10, 1983. An adequacy letter <br />was sent to Empire Energy Corporation on December 29, 1983. <br />Empire Energy Corporation also submitted a revision for the Eagle No. 5 Mine <br />on November 29, 1983 requesting to increase the permit boundary by 173 acres <br />to allow mining in the 2W area.
