I) ~.e <br />_qg_ ~U ~G1111J'`tl <br />The applicant observes, on page IV-SOa of the amended application; <br />"Sections may be added or deleted from any part of the mine to meet <br />production requirements so long as the operational activities are within <br />the permit boundary and the performance standards are met. The system <br />set forth in the permit represents the best engineered estimates of <br />operation, but in no way restricts the number of sections used, location <br />of sections or production tonnage to be produced in the permit area." <br />Any permit issued represents an approval of a specific operations plan, <br />including a proposed mine working configuration and a specific mining <br />schedule. The Division recognizes that timing variations may be caused by <br />conditions beyond the operator's control, and are appropriately the subject of <br />revisions. Mining within areas which might potentially impact renewable <br />resource lands or structures (See Map IV-2 and additions) are deemed <br />appropriate topics for revisions. In addition, the approved mine workings <br />configuration and schedule sequencing within such areas must be followed, <br />unless an appropriate revision has been approved, in advance, by the Division <br />through the normal revision process. However, it is impossible to predict the <br />exact classification of a revision request, until the submisston ins made by <br />the applicant. Mining outside areas which might potentially impact renewable <br />resource lands or structures are excluded from such revision requirements. <br />The Eagle No. 5 and the Eagle No. 9 mine plans are in compliance with <br />stipulations. <br />XX. Subsidence - Rules (2.05.6(6), 4.20) <br />Inventory of Structures and Renewable Resource Lands: <br />The permit application contains an inventory of structures and renewable <br />resource lands within the proposed permit area. The inventoried structures <br />and renewable resource lands are listed on Table IV-10 and depicted on Map <br />IV-2. The applicant identifies five residences which originally comprised the <br />employee residence area of Empire Village. Three of these structures are <br />listed as being removed and two remaining portable trailer-type structures are <br />to remain in areas which are, or will be, undermined. An additional <br />structure, a private residence not owned by Empire Energy Corporation, is <br />located in the NE quarter of the SE quarter of Section 30, T6N, R91W, within <br />the permit area boundaries of the Eagle No. 9 Mine. This structure is the <br />sub3ect of stipulations hereafter. <br />B. Subsidence Survey and Subsidence Prediction <br />The permit application includes an analytical pro3ection of worst-case and <br />probable consequences of subsidence within the permit area. Worst-case <br />predicted and maximum predicted (probable) subsidence projections are <br />presented on Table IV-11 of the permit application. <br />
