Operations Description - Rules 2.05.2. 2.05.3(1), 2.05.3(21. 4.01 <br />The general description of the mining operations and facilities for this <br />five-year permit term has been reviewed by the Division for compliance with <br />the Regulations. Information describing the operation may be found in Volume <br />I, Section IV. <br />The applicant proposes to mine coal at a production rate of 2.7 million tons <br />per year, of which 1.2 million tons would be from Eagle Mine No. 5 and 1.5 <br />million tons would be from Eagle Mine No. 9. As discussed in Section IV of <br />the permit application, only two seams are proposed to be mined during this <br />five-year permit term, the F and the P seams. <br />Empire Energy Corporation proposed partial extraction for the Eagle No. 9 <br />mine. Concerns with the discussion of probable hydrologic consequences and <br />the potential effects of subsidence on renewable resource lands in the Big <br />Bottom area that prevented the Division from recommending approval in the <br />September, 1983 findings document have been resolved in the Eagle Mine No. 9 <br />permit revision application. The Division recommends approval for the limited <br />extraction plan in the Eagle Mine No. 9. <br />The applicant states, on pages IU-49 through IV-50a of the application, that <br />it may be necessary to daylight a ventilation portal within the 2-West area of <br />the Eagle No. 5 Mine. The applicant presents a "general plan" stating the <br />techniques it proposes to employ, if such an operation is undertaken. The <br />application specifically states, on page IV-SOa of the amended application: <br />"The above is a general plan for the daylighttng activity and Empire <br />will submit a minor revision to the Division prior to undertaking any <br />daylighttng. The minor revision request will be submitted when the unit <br />is within 100 feet of daylighttng." <br />The Division deems it necessary to impose the following stipulation upon <br />permit approval. <br />Stipulation 15 <br />THE DIVISION DIRECTS EMPIRE ENERGY CORPORATION TO SUBMIT A PERMIT <br />REVISION REQUEST FOR THE DAYLIGHTING OF A VENTILATION PORTAL WITHIN THE <br />2-WEST AREA OF THE EAGLE N0. 5 MINE PRIOR TO MINING APPROACHING CLOSER <br />THAN 100' TO THE SURFACE. THE DIVISION CANNOT DETERMINE THE <br />SIGNIFICANCE OF SUCH AN OPERATIONAL REVISION PRIOR TO ITS SUBMITTAL, <br />BECAUSE THE NATURE OF THE ENVIRONMENTAL AND MINE PLAN IMPACTS ARE <br />DEPENDENT UPON SITE-SPECIFIC ELEMENTS OF THE SPECIFIC PROPOSED <br />REVISION. FURTHER, THE OPERATOR SHALL NOT PROCEED CLOSER THAN 100' TO <br />THE SURFACE UNTIL A REVISION APPROVAL HAS BEEN GRANTED BY 7HE DIVISION. <br />
