-40 U ~ / U~ <br />Stipulation No. 4 <br />WITHIN 120 DAYS OF PERMIT ISSUANCE, THE DIVISION DIRECTS EMPIRE ENERGY <br />CORPORATION TO MODIFY THE PROPOSED HYDROLOGIC MONITORING PROGRAM TO <br />INCLUDE THE FOLLOWING: <br />A) EMPIRE ENERGY CORPORATION SHALL DETERMINE THE VOLUME OF WATER PUMPED <br />FROM THE MINES ON A WEEKLY BASIS TO MONITOR DISCHARGE FROM ALL MINE <br />WORKINGS. WATER QUALITY AT THE DISCHARGE POINTS SHALL BE MONITORED <br />WEEKLY FOR ELECTRICAL CONDUCTIVITY, pH, AND TEMPERATURE. ON A QUAR7ERLY <br />BASIS THE APPLICANT SHALL MONITOR, IDS, TSS, AND EFFLUENT LIMITATIONS. <br />B) COPIES OF THE NPDES MONITORING REPORT SHALL BE SENT TO THE DIVISION <br />WHICH INCLUDE THOSE SPECIFIC CONSTITUENTS ADDED BY THE DEPARTMENT OF <br />HEALTH TO THE OPERATOR'S NPDES MONITORING (MERCURY, SILVER, CYANIDE, <br />COPPER, LEAD, THALLIUM, CADMIUM, AND ZINC). IF EMPIRE ENERGY <br />CORPORATION REQUESTS THE DEPARTMENT OF HEALTH TO DELETE ANY OF THESE <br />CONSTITUENTS FROM THEIR REQUIRED NPDES MONITORING, THE APPLICANT SHALL <br />SUBMIT A COPY OF THE REQUEST TO THE DIVISION. THE DIVISION SHALL <br />CONSULT WITH THE DEPARTMENT OF HEALTH CONCERNING THIS REQUEST. <br />C) THE OPERATOR'S MONITORING PROGRAM SHALL INCLUDE THE MONITORING OF <br />SPRING WATER QUANTITY AND QUALITY. FOR THE NORTH SPRING (MAP IV-13) <br />WATER QUANTITY AND QUALITY (TEMPERATURE, EC, ANO pH) SHALL BE MONITORED <br />ON A MONTHLY BASIS. FOR THE THREE ADJUDICATED SPRINGS IDENTIFIED ON MAP <br />III-14 (HAXTON SPRING I, AND LIPPARD SPRINGS I AND II) THE OPERATOR <br />SHALL MONITOR FLOW, TEMPERATURE, EC, ANO pH ON A MONTHLY BASIS AND FULL <br />SUITE WATER QUALITY ACCORDING TO THE DIVISION'S WATER QUALITY GUIDELINE <br />ON A QUARTERLY BASIS. <br />D) EMPIRE ENERGY CORPORATION SHALL SUBMI7 THE RESULTS OF ALL ITS <br />HYDROLOGIC MONITORING, INCLUDING NPDES MONITORING, TO THE DIVISION ON A <br />QUARTERLY BASIS. <br />The surface water, ground water, and mine water monitoring plan at the Eagle <br />No. 5 and No. 9 Mines is designed to monitor the effects of the mining <br />operation both during and after mining. This monitoring is to be adequate to <br />plan for modification of surface or underground mining activities, if <br />necessary, to minimize disturbance of the prevailing hydrologic balance {Rule <br />4.05.13(1)(b)). The following stipulation is proposed to insure that the <br />applicant analyzes and uses the collected hydrologic data in the design and <br />operation of mines, in order to minimize the disturbance to the hydrologic <br />balance. <br />
