SO-02, C-1984-065 <br />March 22, 2002 <br />Page 6 of 7 Pages <br />purchaser of record under a real estate contract of the coal to be mined [page 2-4 (2/02)] [Rule <br />2.03.4(6)(b)]. <br />The application states that there is no purchaser of record under a real estate contract of the <br />property to be mined by surface coal mining activities or for underground mining activities, areas <br />affected by facilities incidental thereto, and any purchaser ofrecord under a real estate contract <br />of the coal to be mined. This information was not identified in the initial application, but was <br />provided in response to a request for it by the Division. (Rule 2.03.4(6)(c) <br />The application contains, as revised, the names and addresses of the owners of record of all <br />surface and subsurface areas contiguous to any part of the proposed permit azea [Rule 2.03.4(7)]. <br />The application contained no change to the name of the proposed mine (Coal Ridge No. 1 Mine) <br />and the Mine Safety and Health Administration identification number, OS-03718 for the mine <br />[see page 2-7, annotated 3/02, of the Permit Application Package PAP)] [Rule 2.03.4(8)]. <br />The application included no change with regard to Rule 2.03.4(9) (see Page 2-7, 3/02). <br />The application included information required by 2.03.4 (see above) and by (2.03.5 see <br />following) [Rule 2.03.4(10)]. <br />The application included no changes to information in the existing PAP with regard to Rules <br />2.03.5, 2.03.5(1), 2.03.5(1)(a) (see page 2-7 annotated 3/02), 2.03.5(1)(b) (see page 2-7 <br />annotated 3/02), and 2.03.5(2) (see page 2-7 annotated 3/02). There have been no violations as <br />addressed by Rule 2.03.5(3). <br />The applicant will be provided an opportunity to provide the information required by Rule <br />2.03.5(4) prior to issuance of the permit. <br />The application included current information in pazagraph 2.4 on page 2-7 annotated 3/02 of the <br />PAP (Rule 2.03.6). <br />The application contains (no change) a complete and detailed legal description ofthe proposed <br />permit boundary, a description of the documents upon which the applicant bases his or her legal <br />right to enter and begin surface coal mining operations in the permit azea, and a statement as to <br />whettrer that right is the subject of pending litigation. The description identified those documents <br />by type and date of execution, identify the specific lands to which the document pertains, and <br />explain the legal rights claimed by the applicant. <br />There was no surface mining of coal proposed in the application [Rule 2.03.6(2)]. <br />There was no change in the application with regard to Rule 2.03.7. <br />
