Another check will be made immediately prior to issuance of <br />the transfer. <br />Determination of Compliance. The applicant's compliance with the requirements of Rules <br />2.08.6(2) and 2.08.6.3) was evaluated. <br />Written Findings. These written findings were prepared on the application. <br />Proposed Decision. Based on these findings, the Division will promulgate a proposed decision <br />on the transfer. <br />Public Notice, Division. Although not required by the Rules, the practice of the Division is to <br />make public notice of a proposed transfer. This notice will published in the Glenwood Springs <br />Post Independent. <br />Final Approval of the Transfer. In the absence of objection the proposed decision becomes fmal <br />30 days following the public notice by the Division. <br />Permit History <br />Storm King Mines Inc submitted the initial application for Permit C-84-065 for the Coal Ridge <br />No. 1 Mine on March 12, 1984. The company changed its name to New Castle Energy <br />Corporation (NCEC) on July 26, 1985. The permit was first issued on October 9, 1985, and was <br />renewed on December I0, 1989. The permit was transferred to NCIG Financial, Inc. on July 1Q <br />1991. The permit was renewed on January 30, 1993, Februazy 28, 1997, and on October 9, 2001. <br />The current pemut expires on October 9, 2006. This is the second transfer of the permit in the <br />Division permit system. <br />Prerequisite Compliance <br />Compliance with Rules 2.08.6(2) and 2.08.6(3) is a prerequisite to granting of written approval <br />for the transfer. The Division found the application (applicant's) in compliance with these rules. <br />The applicants (permittee and successor) opted to continue the bond posted by the permittee in <br />force [Rule 2.08.6(2)(a)(ii)]. <br />The Division was provided an application on a form approved by the Colorado Mined Land <br />Reclamation Board for approval of the transfer [Rule 2.08.6(2)(b)] which included the name and <br />address of the existing permittee (NCIG)[Rule 2.08.6(2)(b)(i)]; the name and address of the <br />successor (C.B. Minerals) [Rule 2.08.6(2)(b)(ii)]; and the name and address of successor's <br />
