certified inspection report on February 20, 1998. The Division considers this issue <br />resolved as long as the permittee continues to submit these engineer's reports <br />quarterly. However, BRL has the option of submitting a final certified engineer's <br />report showing that the old waste pile has been fully reclaimed according to Rule <br />4.10.2(2)(a). <br />13. OSM was concerned that a slight bulge at the southern end of the West Ridge <br />waste pile could be evidence of a slump. Initially, BRL was planning on installing <br />a silt fence at the southern end of the West Ridge waste pile, at the base of the <br />apparent bulge, in order to determine if there was any active movement in the <br />bulge. <br />Although DMG agrees that there appears to be a slight bulge in the southern tip of <br />the West Ridge waste pile, DMG does not believe that the installation of a silt <br />fence is appropriate as the next investigative step. First, there is no corroborating <br />evidence of a slump, such as cracking. Second, digging a trench for the silt fence <br />installation might initiate a slump. Third, if there really is an active slump, there <br />may be better methods that can be used to determine this. DMG believes that <br />continued monitoring of the area for slump cracks would be preferable at this time. <br />Should cracks appear in this waste pile section, further evaluation of the situation <br />would be needed. <br />14. OSM believed that leaning trees at the base of the southern end of the old waste <br />pile may be a sign of slumping of the waste pile. DMG was going to review old <br />photographs in order to determine if there had been slumping or whether the trees <br />were leaning due to construction of the waste pile buttress berm. <br />DMG inspected old photographs but could not find any photographs which <br />showed the area of interest in enough detail. DMG believes that although there <br />were trees which were leaning, there were also trees in the vicinity which were not <br />leaning. In addition, even if there had been a slump in this portion of the old waste <br />pile, there are no signs that the slump is active now. The Division will continue to <br />monitor this area in the field. If any evidence of active slumping is found, further <br />evaluation of the situation will be conducted. <br />15. OSM requested that BRL submit a more detailed engineer's certification of the <br />new underdrain in the northeast corner of the West Ridge waste pile. <br />DMG agreed with OSM.
