9. DMG and OSM observed that the coal refuse material that, recently, had been <br />placed in the northeast section of the West Ridge waste pile needed regrading so <br />that it would have positive drainage off of the waste pile. <br />BRL regraded the new West Ridge waste pile addition so that the surface drainage <br />from [he active part of the waste pile would flow to the northeast part of the pile. A <br />berm was established along the south and east sides of the addition so that surface <br />runoff from the active part of the pile would not flow over the side and down the <br />reclaimed slope. A notch in the berm in the northeast section of the new waste pile <br />addition allows the surface runoff from the active pile to flow off of the waste pile <br />and into the adjoining drainage without erosional problems. Straw bales in the <br />notch provide sediment control. DMG believes that this issue has been resolved. <br />10. DMG and OSM observed that the diversion ditch F-F, located on the north and <br />northeast sides of the old waste pile, needed touch up work. <br />BRL agreed to do this work. However, this work has not been done yet. As stated <br />in item number 8 above, site conditions had become muddy and prevented repair <br />work. However, at the time of the special focus inspection, it had been observed <br />that, although the ditch needed touch up work, the ditch still had capacity. In <br />addition, the sideways tilt of the adjacent light use road, towards the ditch and <br />away from the old refuse pile, would further protect the refuse pile from surface <br />runoff should the ditch overtop. However, enforcement action will be taken if this <br />ditch falls out of compliance before the repair work can be performed. <br />11. OSM observed that BRL needed to reestablish a berm on top of the West Ridge <br />waste pile so that surface runoff would be directed off of the reclaimed slope. <br />DMG agreed and BRL performed the necessary maintenance work by <br />reestablishing the berm. DMG believes this issue has been resolved. <br />12. OSM stated that Colorado Regulations 4.09.1(11)(a) and (b) require that the old <br />waste pile should be inspected quarterly, with the engineer's reports submitted to <br />DMG. <br />DMG concurs. BRL agreed to continue the engineer's quarterly certified <br />inspections of the old waste pile, with submittal to DMG of the reports within two <br />weeks of the inspection. As stated in item number 4 above, the permittee did <br />inspect the old waste pile on February 16, 1998, and submitted the engineer's <br />a <br />
