DMG investigated this matter. Volume 6A of the permit application contains [he <br />designs for the east addition of the West Ridge waste pile, in the March 1994 <br />report entitled "Proposed 1994 West Ridge Waste Pile Modifications." Referring <br />to page 4 of Section 3.6 of that report and to Figure 4, the toe bench was to be <br />excavated into the hillside in order to provide a flat bench for the placement of <br />waste material. This bench was not seen during the inspection because the waste <br />material and the waste pile outslope cover material had already been placed on top <br />of this bench. <br />The photographs, which had been taken by the engineer during the construction of <br />the waste pile addition, show the excavation of this toe bench. The photographs <br />show that the toe bench had been excavated into the hillside and was <br />approximately 30 feet wide and 100 feet long. DMG believes that this issue has <br />been resolved. <br />3. OSM stated that the depths of cover material and topsoil should be verified for <br />both the West Ridge waste pile and the old waste pile. <br />DMG agrees that topsoil and cover material depths need to be verified. However, <br />an examination of DMG's files did not reveal any DMG inspection where direct <br />verification of topsoil or cover material depths on the old waste pile or the West <br />Ridge waste pile had been obtained. Therefore, a future DMG inspection will need <br />to deal with this subject. The Division believes that, as far as this special focus <br />inspection is concerned, this issue has been resolved, provided the verification will <br />be successful. <br />4. OSM stated that BRL must submit the engineer's quarterly inspection report of the <br />waste piles within two weeks of the engineer's inspection, as required in Rule <br />4.09.1(11)(b). <br />DMG agrees with OSM. BRL agreed to submit these inspection reports to DMG <br />within two weeks of the inspection. The first quarter 1998 engineer's inspection of <br />the West Ridge waste pile and the old gob pile was conducted on February 16, <br />1998 and the certified reports were submitted to the Division on February 20, <br />1998. As long as this commitment is adhered to, the Division considers this issue <br />to be resolved. <br />OSM stated that the engineer must attest in the certification of the waste piles that <br />
