Stipulation No. 21 <br /> The applicant must install monitoring wells in, conduct pumping test on, and <br /> monitor water levels and water quality in the alluvium of Dry Fork, Lick Creek, <br /> South Prong and Horse Creek one year prior to mining within the watersheds of <br /> these streams. The applicant shall submit to the Division the data and results of <br /> these tests and monitoring along with projected impacts prior to conducting mining <br /> within any of the watersheds. <br /> Because South Prong and Horse Creek are still part of the life-of-mine permit area, the <br /> stipulation status will remain "future." <br /> STATUS: Future <br /> Stipulation No. 22 <br /> In its annual hydrology assessment, the applicant shall continue to include water <br /> quantity data from the U.S.G.S. Somerset Monitoring Station. Should the U.S.G.S. <br /> discontinue monitoring at this location, the operator shall submit its own quantity <br /> monitoring program for the North Fork of the Gunnison. <br /> This stipulation has been incorporated into the permit application on page 2.04-67, <br /> formerly on page 2-358, and has been terminated as of October 27, 1989. <br /> STATUS: Terminated <br /> Stipulation No. 23 <br /> The applicant shall continue to submit to the Division copies of the reports, exhibits <br /> and all subsequent amendments submitted to the Gunnison County Planning <br /> Commission, titled Protection of Minnesota Creek Water Supply. <br /> STATUS: Terminated <br /> Stipulation No. 24 <br /> All data and reports submitted to the State Engineer's Office and ditch companies <br /> shall be copied to MLRD as inclusions within the quarterly report required under <br /> Section 4.05.13(2) of the Rules and Regulations. <br /> STATUS: Terminated <br /> Stipulation No. 25 <br /> West Elk Coal Company shall submit within ninety (90) days of the approval of the <br /> waste pile permit revision a plan to monitor the formation of a perched aquifer <br /> 11 <br />
