As of 1997, no active surface operations are ongoing <br />or proposed nor aze they within 500 feet of the Foidel Creek Mine (4.19(1) and <br />4.22.4(1)). <br />XV. Subsidence Control <br />Eckman Park has no underground operations. All underground operations within the <br />permit azea are associated with the Foidel Creek Mine, permit #C-82-056. Therefore, the <br />requirements of this section do not apply. <br />XVI. Concurrent Surface and Underground Mining <br />The Division granted a variance from contemporaneous reclamation for portions of the <br />permit azea in order that underground mining can be developed at the Foidel Creek Mine <br />(4.22.2). <br />The Division finds [hat the requirements of Rule 4.22.3 have been met. <br />XVII. Operations on Alluvial Vallev Floors <br />The Division has determined that an alluvial valley floor exists within the affected or <br />adjacent area. Therefore, the following findings aze in order for the alluvial valley floors <br />known as the Fish Creek AVF, Upper Middle Creek AVF, Foidel/Middle Creek AVF, <br />and the Trout Creek AVF. A portion of Foidel Creek, downstream from the Eckman <br />Park and Mine 1 permit area had previously been considered an AVF. This <br />determination had been made on a lack of evidence to make a negative determination. In <br />May 1996, a Permit Revision (PR-03) was approved for the Foidel Creek Mine. During <br />the Foidel Creek Permit Revision No. 3, the Division determined that the portion of <br />Foidel Creek did not qualify as an AVF. <br />Information regarding alluvial valley floors in the permit and adjacent area is provided <br />on Pages 785-6 through 785-24 and Map 6 and 51 of the updated C-81-071 permit <br />document. Map 6 was utilized by the Division in making the alluvial valley floor <br />determinations set forth below. In addition, certain information regarding alluvial valley <br />floors downstream from the permit area on Fish Creek, Foidel Creek, Middle Creek and <br />Trout Creek was presented in Twentymile Coal Company's Life-of--Mine Permit Revision <br />application for the Foidel Creek Underground Mine (C-82-056) and is referenced in this <br />document. <br />Potentially affected portions of Foidel Creek, Middle Creek, Fish Creek and Lower Trout <br />Creek stream valleys have previously been evaluated with respect to AVF criteria in a <br />number of coal permits, including Twentymile Coal Company's Foidel Creek Mine <br />25 <br />
