Mines, and that improved resource recovery, abatement of water pollution, and
elimination of hazards will result. As of 1997, no active surface operations are ongoing
or proposed nor aze they within 500 feet of the Foidel Creek Mine (4.19(1) and
4.22.4(1)).
XV. Subsidence Control
Eckman Park has no underground operations. All underground operations within the
permit azea are associated with the Foidel Creek Mine, permit #C-82-056. Therefore, the
requirements of this section do not apply.
XVI. Concurrent Surface and Underground Mining
The Division granted a variance from contemporaneous reclamation for portions of the
permit azea in order that underground mining can be developed at the Foidel Creek Mine
(4.22.2).
The Division finds [hat the requirements of Rule 4.22.3 have been met.
XVII. Operations on Alluvial Vallev Floors
The Division has determined that an alluvial valley floor exists within the affected or
adjacent area. Therefore, the following findings aze in order for the alluvial valley floors
known as the Fish Creek AVF, Upper Middle Creek AVF, Foidel/Middle Creek AVF,
and the Trout Creek AVF. A portion of Foidel Creek, downstream from the Eckman
Park and Mine 1 permit area had previously been considered an AVF. This
determination had been made on a lack of evidence to make a negative determination. In
May 1996, a Permit Revision (PR-03) was approved for the Foidel Creek Mine. During
the Foidel Creek Permit Revision No. 3, the Division determined that the portion of
Foidel Creek did not qualify as an AVF.
Information regarding alluvial valley floors in the permit and adjacent area is provided
on Pages 785-6 through 785-24 and Map 6 and 51 of the updated C-81-071 permit
document. Map 6 was utilized by the Division in making the alluvial valley floor
determinations set forth below. In addition, certain information regarding alluvial valley
floors downstream from the permit area on Fish Creek, Foidel Creek, Middle Creek and
Trout Creek was presented in Twentymile Coal Company's Life-of--Mine Permit Revision
application for the Foidel Creek Underground Mine (C-82-056) and is referenced in this
document.
Potentially affected portions of Foidel Creek, Middle Creek, Fish Creek and Lower Trout
Creek stream valleys have previously been evaluated with respect to AVF criteria in a
number of coal permits, including Twentymile Coal Company's Foidel Creek Mine
25
