XXIII. Subsidence - Rules 2.05.6(6) and 4.20
Information regarding subsidence for the Munger Canyon operation is provided
in Section 2.1.6 of Vo1u~ i of the application. The applicant states that no
structures or renewable resource lands exist within the proposed permit and
adjacent areas. The Division concurs with that opinion. The applicant is,
therefore, in conformance with the requirements of Rules 2.05.6(6) and 4.20.
No subsidence monitoring is required for this operation. The operation is in
compliance with the requirements of this section.
XXIV. Special Categories - Rules 2.06, 4.22, 4.23, 9.26, 4.27, 4.28 and 4.29
As discussed in Sections XII (Backfilling and Grading) and XX (Roads), portions
of the proposed haul road and mine portal bench constitute "steep slope mining
areas". The applicant has submitted an appropriate backfill and grading plan
in conformance with the requirements of Rules 2.06.4 and 4.27, and a request for
variance from approximate original contour based upon steep slope mining
conditions in accordance with Rule 2.06.5. It is the applicant's intention not
to achieve approximate original contour. The applicant has adequately demonstrated
conformance with the provisions of Rule 2.06.5 in this regard.
The operation is in compliance with the requirements of this section.
XXV. Miscellaneous Compliance - Rules 2.05.6(5), 4.02, 4.12, 4.19, 4.21,
4.28 and 4.30
Salt Creek Mining Company intends to comply with all applicable regulations with
respect to signs and markers at the mine and Ioadout facility. There are no
surface mines anywhere near the proposed underground workings associated with the
operation.
Details of the Low loadout are provided in Sections II (Land Use), V (Surface
water), VII (Alluvial Valley Floors), IV (Probable Hydrologic Functions, XV
(Operations Plan) and XIX (Mine Facilities, Coal Handling Facilities, Support
Facilities) of this document.
The operation is in compliance with the requirements of this section.
XXVI. Operation on Lands Subject to Limitations or Prohibitions - Rules 2.03.7
and 2.10
The proposed operation is in compliance with the requirements of this section
and Rule 2.07.6(2)(d) for the following reasons:
The permit area of the proposed operation is not within:
a. an area designated as unsuitable for mining;
b. an area under study for designation as unsuitable for surface coal
mining;
c. on any lands subject to prohibitions or limitations; or
d. within 300 feet from any occupied dwelling.
