-40- <br />XXIII. Subsidence - Rules 2.05.6(6) and 4.20 <br />Information regarding subsidence for the Munger Canyon operation is provided <br />in Section 2.1.6 of Vo1u~ i of the application. The applicant states that no <br />structures or renewable resource lands exist within the proposed permit and <br />adjacent areas. The Division concurs with that opinion. The applicant is, <br />therefore, in conformance with the requirements of Rules 2.05.6(6) and 4.20. <br />No subsidence monitoring is required for this operation. The operation is in <br />compliance with the requirements of this section. <br />XXIV. Special Categories - Rules 2.06, 4.22, 4.23, 9.26, 4.27, 4.28 and 4.29 <br />As discussed in Sections XII (Backfilling and Grading) and XX (Roads), portions <br />of the proposed haul road and mine portal bench constitute "steep slope mining <br />areas". The applicant has submitted an appropriate backfill and grading plan <br />in conformance with the requirements of Rules 2.06.4 and 4.27, and a request for <br />variance from approximate original contour based upon steep slope mining <br />conditions in accordance with Rule 2.06.5. It is the applicant's intention not <br />to achieve approximate original contour. The applicant has adequately demonstrated <br />conformance with the provisions of Rule 2.06.5 in this regard. <br />The operation is in compliance with the requirements of this section. <br />XXV. Miscellaneous Compliance - Rules 2.05.6(5), 4.02, 4.12, 4.19, 4.21, <br />4.28 and 4.30 <br />Salt Creek Mining Company intends to comply with all applicable regulations with <br />respect to signs and markers at the mine and Ioadout facility. There are no <br />surface mines anywhere near the proposed underground workings associated with the <br />operation. <br />Details of the Low loadout are provided in Sections II (Land Use), V (Surface <br />water), VII (Alluvial Valley Floors), IV (Probable Hydrologic Functions, XV <br />(Operations Plan) and XIX (Mine Facilities, Coal Handling Facilities, Support <br />Facilities) of this document. <br />The operation is in compliance with the requirements of this section. <br />XXVI. Operation on Lands Subject to Limitations or Prohibitions - Rules 2.03.7 <br />and 2.10 <br />The proposed operation is in compliance with the requirements of this section <br />and Rule 2.07.6(2)(d) for the following reasons: <br />The permit area of the proposed operation is not within: <br />a. an area designated as unsuitable for mining; <br />b. an area under study for designation as unsuitable for surface coal <br />mining; <br />c. on any lands subject to prohibitions or limitations; or <br />d. within 300 feet from any occupied dwelling. <br />
