-39- <br />The following stipulation is therefore required: <br />Stipulation No. I8 <br />PRIOR TO CONSTRUCTION OF THE HAUL ROAD, THE PERMITTEE MUST <br />PROPOSE THE INSTALLATION OF ADDITIONAL ROAD SURFACE DRAINAGE <br />CULVERTS TO MEET THE SPACING REQUIREMENTS OF RULE 4.03.1(4)(e)(vi)(A). <br />ALTERNATIVE SPECIFICATIONS MAY BE UTILIZED UNDER THE PROVISIONS <br />IN RULE 4.03.1 (9)(e)(vi) IF THE PERMITTEE DEMONSTRATES THAT <br />THESE SPECIFICATIONS WILL NOT RESULT IN AN INCREASE IN EROSION. <br />With the acceptance of the above stipulations, the proposed operation is in <br />conformance with the requirements of this section. <br />XXI. Bonding - Rule 2.05,4(2)(b) and Rule 3 <br />Salt Creek Mining Company has agreed to post a performance bond in the amount of <br />$ The Division has determined that this amount will be sufficient <br />to cover the cost of reclamation at the Munger Canyon Mine. <br />Pursuant to Rules 2.07.6(2)(j) and 3.02.I(1), the performance bond in this <br />amount will be filed with the Division, payable to the State of Colorado, and <br />the Office of Surface Mining before a permit will be issued. <br />The following stipulation is required by the Division: <br />Stipulation No. 19 <br />A PERFORMANCE BOND IN THE AMOUNT OF .$ 307,630,00,. PAYABLE TO THE <br />STATE OF COLORADO AND THE OFFICE OF SURFACE MINING, MUST BE <br />FILED WITH THE DIVISION WITHIN 60 DAYS OF THE NOTICE OF PRO- <br />POSED DECISION. <br />The applicant is in compliance with the requirements of this section. <br />XXII. Sealing of Drill Holes and Underground Openings - Rules 2.05.9(2)(g) <br />and 4.07 <br />The appropriate information satisfying these requirements appears in Sections <br />2.1 and 3.7 of the application (Volume I). The applicant has committed to <br />conform with all the applicable reguiations regarding the sealing and management <br />of borings. <br />The applicant proposes to abandon the portals at the Munger Canyon Mine by <br />constructing a 16 inch thick double concrete block wall, keyed a minimum of <br />12 inches into the floor, roof and ribs. This wall will be constructed at a <br />minimum of 25 feet from the surface. Following completion of the concrete block <br />wall, the remaining portion of the portal will be backfilled with incombustible <br />materials. As such, the porposed technique conforms with the M.S.H.A. regu- <br />lations as stated in 30 CFR 75-1711, Federal Code of Regulations. The technique <br />will also satisfy the requirements of the permanent regulatory program. Drainage <br />wiZ1 not occur at the portals, based upon information submitted with the appli- <br />cation. <br />The operation is in compliance with the requirements of this section. <br />
